Accordingly, this legislation, the first ever of its kind in Canada, would affirm these rights and obligations, including rights to consular access, consular visits and repatriation; reporting requirements for Canadian officials when they suspect a Canadian detained or captured abroad has been or may be tortured; and requirements that the government request the repatriation of a Canadian detained abroad in situations where there are reasonable grounds to believe that the Canadian has been or may be tortured, is being subjected to conditions constituting cruel or unusual punishment, or is being arbitrarily detained.

Is disturbed by the testimony given to the temporary committee by the Canadian citizen, Maher Arar, who was arrested by the US authorities, transferred by the CIA through a European airport and detained for twelve months in Syria, where he was subjected to torture; notes at the same time the statement given by US legal adviser, John Bellinger, who stated during the visit of the temporary committee delegation to the USA that the Arar case was dealt with under US immigration and customs law and had nothing to do with the alleged cases of rendition;

Last week, I was in Geneva attending a meeting of the Committee Against Torture, which was examining Canada's fourth and fifth report. There I heard, with my own ears, the Canadian representative state that it was acknowledged that Canada's position on the exceptional nature of the Suresh decision, which dealt with an individual who was returned to a country where they practise torture, is completely incompatible with the Convention Against Torture.
