In reply to the Lisbon Treaty comment from my colleague Liam Aylward, may I say that, yes, inspections did cause a problem.

Following the publication in the Official Journal of the European Union on 10 October 2007 of the Decision to initiate proceedings pursuant to Article 88(2) of the EC Treaty (hereinafter ‘the opening Decision’), in which it invited the interested parties to submit their comments, the Commission received comments from the aid beneficiary, by letters registered on 26 November 2007 and 7 April 2008.

Although the procedure was initiated under the ECSC Treaty, since it was not possible in practice to adopt a final decision before 23 July 2002 (Belgium’s reaction to the comments from interested parties arrived only on 17 June 2002, and additional information was provided subsequently, see recital 4 of this Decision), the Commission made it clear, in its notice on certain aspects of the treatment of competition cases resulting from the expiry of the ECSC Treaty (15), that it would in such cases adopt a final decision under Article 88(2) of the EC Treaty (point 43 of the notice).

Following the invitation to submit comments on the initiation of procedure, the Commission did not receive any observations from RTP's competitors indicating or demonstrating that RTP was engaged in anti-competitive behaviour in commercial markets that could lead to increased state funding incompatible with the Treaty (91).

These comments, made by a Member of Parliament, are an attack on the values which formed a basis for the construction of both the EU itself and the Charter of Fundamental Rights, as included in the Constitutional Treaty. I should like to say from the outset that if a debate were to be held on parliamentary immunity as a result of the legal proceedings which cannot fail to be instigated, I would be in favour of waiving this immunity.

(59) As regards certain comments from third parties which maintain that the effect on trade should be assessed by the Commission on the basis of a comparison of all tax systems, the Commission would point out that the distortions of competition which are the subject of this procedure under Articles 87 and 88 of the Treaty are due to a derogating rule which favours certain firms vis-à-vis the other firms of the Member State; they are not possible distortions of competition which are due to differences between the tax systems of the Member States, which might, as appropriate, be caught by the provisions of Articles 93 to 97.
(59) En ce qui concerne le commentaire de certains tiers selon lequel l'affectation des échanges devrait être appréciée par la Commission en comparant l'ensemble des systèmes fiscaux, la Commission rappelle que les distorsions de concurrence faisant l'objet de la présente procédure au titre des articles 87 et 88 du traité sont celles découlant d'une norme dérogatoire concrète qui favorise certaines entreprises parmi les contribuables de l'État membre et non les éventuelles distorsions de concurrence découlant des divergences entre les systèmes fiscaux des États membres qui, le cas échéant, pourraient tomber sous le coup des dispositions des articles 93 à 97.
