1. A Community trade mark court hearing an action referred to in Article 96, other than an action for a declaration of non-infringement shall, unless there are special grounds for continuing the hearing, of its own motion after hearing the parties or at the request of one of the parties and after hearing the other parties, stay the proceedings where the validity of the Community trade mark is already in issue before another Community trade mark court on account of a counterclaim or where an application for revocation or for a declaration of invalidity has already been filed at the Office.

Sauf s'il existe des raisons particulières de poursuivre la procédure, un tribunal des marques communautaires saisi d'une action visée à l'article 96, à l'exception d'une action en constatation de non-contrefaçon, sursoit à statuer, de sa propre initiative après audition des parties ou à la demande de l'une des parties et après audition des autres parties, lorsque la validité de la marque communautaire est déjà contestée devant un autre tribunal des marques communautaires par une demande reconventionnelle ou qu'une demande en déchéance ou en nullité a déjà été introduite auprès de l'Office.
