There are several co-decided regulations that transpose technical measures agreed for third-country waters covered under Regional Fisheries Management Organisations (RFMOs) such as the Convention on Conservation on Antarctic Living Marine Resources (CCALMR) and the International Convention for the Conservation of Atlantic Tunas (ICCAT) among others.

The Union, as a Party to the Convention on the Conservation of European Wildlife and Natural Habitats, approved by Council Decision 82/72/EEC , has undertaken to take all appropriate measures to ensure the conservation of the habitats of the wild flora and fauna species.

Some of those special provisions have been transposed into Community law by Council Regulation (EEC) No 3943/90 of 19 December 1990 on the application of the system of observation and inspection established under Article XXIV of the Convention on the Conservation of Antarctic Marine Living Resources, by Council Regulation (EC) No 66/98 of 18 December 1997 laying down certain conservation and control measures applicable to fishing activities in the Antarctic and repealing Regulation (EC) No 2113/96, and by Council Regulation (EC) No 1721/1999 of 29 July 1999 laying down certain control measures in respect of vessels flying the flag of Non-Contracting Parties to the Convention on the Conservation of Antarctic Marine Living Resources.

Some of the technical measures adopted by the CCAMLR have been transposed by Council Regulation (EEC) No 3943/90 of 19 December 1990 on the application of the system of observation and inspection established under Article XXIV of the Convention on the Conservation of Antarctic Marine Living Resources and by Council Regulation (EC) No 66/98 of 18 December 1997 laying down certain conservation and control measures applicable to fishing activities in the Antarctic.

For that reason, the Commission proposes that Regulations (EEC) No 3943/90 and (EC) No 66/98 should be repealed and replaced by a new Council Regulation laying down certain control measures applicable to fishing activities in the area covered by the Convention on the conservation of Antarctic marine living resources.

By letter of 18 July 2002 the Council consulted Parliament, pursuant to Article 37 of the EC Treaty, on the proposal for a Council Regulation laying down certain technical measures applicable to fishing activities in the area covered by the Convention on the conservation of Antarctic marine living resources (COM(2002) 355 – 2002/0138(CNS)).

The Convention on the Conservation of Antarctic Marine Living Resources was approved by the Community by Council Decision 81/691/EEC and entered into force in the Community on 21 May 1982.
Het Verdrag inzake de instandhouding van de levende rijkdommen in de Antarctische wateren werd door de Gemeenschap middels besluit 81/691/EEG van de Raad goedgekeurd en trad in de Gemeenschap op 21 mei 1982 in werking.
