However, despite repeated calls by the Council and the Commission, Turkey has still not complied with its obligation of full non-discriminatory implementation of the Additional Protocol to the Association Agreement and has not removed all obstacles to the free movement of goods, as outlined in the declaration of the European Community and its Member States of 21 September 2005 and in the Council conclusions, including the December 2006 and December 2010 conclusions.
Ondanks herhaalde oproepen van de Raad en de Commissie heeft Turkije nog steeds niet voldaan aan zijn verplichting om het Aanvullend Protocol bij de associatieovereenkomst volledig en op niet-discriminerende wijze toe te passen en heeft het niet alle belemmeringen voor het vrije verkeer van goederen weggenomen, zoals beschreven in de verklaring van de Europese Gemeenschap en haar lidstaten van 21 september 2005 en in de conclusies van de Raad, met name die van december 2006 en december 2010.

Financing of the programmes and projects shall be subject to compliance with the commitments contained in the EC-Turkey Association Agreement, Decision No 1/95 of the EC-Turkey Association Council of 22 December 1995 on implementing the final phase of the Customs Union(10) and all other related agreements and decisions, and the conditions laid down in Article 4 of Regulation (EC) No 390/2001, in the Accession Partnership with Turkey and in this Regulation.

Despite repeated calls by the Council and the Commission, Turkey has still not fulfilled its obligation to ensure full and non-discriminatory implementation of the Additional Protocol to the Association Agreement and has not removed all obstacles to the free movement of goods, including restrictions on direct transport links with Cyprus.

By letter to the Commission, Toy Industries of Europe, the European association of writing materials manufacturers, the French association of toy manufacturers and the European Balloons Council shared their concerns with regard to the obstacles the German measures, if accepted, will create on the functioning of the toys internal market.

The principles thus referred to by the General Court, and not challenged by the French Republic, may also be found in the Court of Justice’s case-law (see, in connection with Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan (OJ 2002 L 139, p. 9), Kadi and Al Barakaat v Council and Commission, paragraphs 338 to 341).

Decision No 2/2006 of the EC-Turkey Association Council of 17 October 2006 (7) approves a Community position in the EC-Turkey Association Council on the amendment to Protocols 1 and 2 to Decision 1/98 of the EC-Turkey Association Council on the trade regime for agricultural products.
Bij Besluit nr. 2/2006 (7) is het standpunt van de Gemeenschap goedgekeurd in de Associatieraad EG-Turkije over de wijziging van de protocollen nrs. 1 en 2 die aan Besluit nr. 1/98 van de Associatieraad EG-Turkije betreffende de handelsregeling voor landbouwproducten zijn gehecht.

(21) Community education, training and youth programmes are open to the countries of the European Free Trade Association participating in the European Economic Area and the associated countries of Central and Eastern Europe (CCEE), in accordance with the conditions set out in the Europe Agreements, in their additional protocols and in the decisions of the relevant Association Councils, and to Cyprus, Malta and Turkey.
(21) Aan de communautaire programma's inzake onderwijs, beroepsopleiding en jeugd kan worden deelgenomen door de lidstaten van de Europese Vrijhandelsassociatie die deelnemen aan de Europese Economische Ruimte en door de landen van Midden en Oost-Europa (LMOE), overeenkomstig de voorwaarden die zijn vastgesteld in de Europaovereenkomsten, in de aanvullende protocollen daarbij en in de besluiten van de respectieve associatieraden, door Cyprus, alsmede door Malta en door Turkije.

Whereas, for olive oil falling within CN codes 1509 10 10, 1509 10 90 and 1510 00 10, Decision No 1/77 of the EC-Turkey Association Council provides for special arrangements comprising a flat rate deduction of ECU 0,7245 per 100 kilograms from the levy applicable to that oil; whereas, provided that Turkey levies an export charge, those arrangements provide for a further reduction of that levy corresponding to the amount of the special charge, but not exceeding ECU 13,14 per 100 kilograms, representing the reduction provided for in Article 2 of the Association Agreement and a reduction of ECU 13,14 per 100 kilograms, representing the additional amount provided for in Annex IV to that Agreement; whereas the Community has concluded an agreement in the form of an exchange of letters with Turkey extending the aforementioned special arrangements for the duration of the Association Agreement with Turkey, on the basis of a flat-rate reduction in the customs duties (2);
Overwegende dat voor olijfolie van de GN-codes 1509 10 10, 1509 10 90 en 1510 00 10 de geldende heffing forfaitair met 0,7245 ecu per 100 kg wordt verminderd uit hoofde van de speciale regeling die is ingesteld bij Besluit nr. 1/77 van de Associatieraad EEG-Turkije; dat, mits Turkije een bijzondere uitvoerheffing toepast, de heffing bij invoer bovendien wordt verminderd met een bedrag gelijk aan de bijzondere uitvoerheffing, met een maximum van 13,14 ecu per 100 kg, uit hoofde van de vermindering bedoeld in artikel 2 van de bovenbedoelde Overeenkomst en met nog eens 13,14 ecu per 100 kg uit hoofde van het aanvullende bedrag bedoeld in bijlage IV bij dezelfde Overeenkomst; dat de Gemeenschap met Turkije een Overeenkomst in de vorm van een briefwisseling heeft gesloten waarbij de speciale regeling voor de duur van de Associatieovereenkomst wordt voortgezet in de vorm van een forfaitaire vermindering van de douanerechten (2);
