Commission Regulation (EC) No 1875/2006 (2) has introduced in Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code (3) an obligation for economic operators to provide electronic entry and exit summary declarations to the customs authorities for goods entering or leaving the customs territory of the Community, in order to enable those authorities to carry out computerized risk analysis on the basis of such information before the goods are brought into or out of the customs territory of the Community.

(10) Whereas the competent authorities should ensure that products leaving the Community or in transit to a particular destination are in fact those which have undergone the customs export formalities; whereas, to this end, when a product crosses the territory of other Member States before leaving the customs territory of the Community or reaching a particular destination, use should be made of the T5 control copy referred to in Articles 471 to 495 of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code(8), as last amended by Regulation (EC) No 502/1999(9); whereas, however, it seems desirable, in order to simplify administrative procedure, to provide more flexible arrangements than the use of the T5 control copy, in the case of transactions under the simplified Community transit procedures for carriage by rail or large containers under Articles 412 to 442 of Regulation (EEC) No 2454/93, which provides that when a transport operation begins within the Community and is to end outside it, no formalities need to be carried out at the customs office of the frontier station;
(10) Overwegende dat de bevoegde autoriteiten zich ervan dienen te vergewissen dat de producten die de Gemeenschap verlaten of die met het oog op bepaalde bestemmingen worden geleverd, dezelfde producten zijn als die waarvoor de douaneformaliteiten bij uitvoer werden vervuld; dat te dien einde, wanneer een product alvorens het douanegebied van de Gemeenschap te verlaten of een bijzondere bestemming te bereiken over het grondgebied van andere lidstaten wordt vervoerd, het controle-exemplaar T5 moet worden gebruikt dat is bedoeld in de artikelen 471 tot en met 495 van Verordening (EEG) nr. 2454/93 van de Commissie van 2 juli 1993 houdende vaststelling van enkele bepalingen ter uitvoering van Verordening (EEG) nr. 2913/92 van de Raad tot vaststelling van het communautair douanewetboek(8), laatstelijk gewijzigd bij Verordening (EG) nr. 502/1999(9); dat het evenwel ter vereenvoudiging van de administratieve werkzaamheden wenselijk is in een soepelere procedure te voorzien dan die van het controle-exemplaar T5 voor die gevallen waarin gebruik wordt gemaakt van de regeling inzake vereenvoudigd communautair douanevervoer per spoor of in grote containers als bedoeld in de artikelen 412 tot en met 442 van Verordening (EEG) nr. 2454/93, in welke regeling is bepaald dat, wanneer een vervoersbeweging binnen de Gemeenschap begint en daarbuiten dient te eindigen, bij het douanekantoor waaronder het grensstation ressorteert geen enkele formaliteit behoeft te worden vervuld;

Whereas certain territories forming part of the Community customs territory are regarded as third territories for the purposes of applying the common system of value added tax; whereas value added tax is therefore applied to trade between the Member States and those territories according to the same principles as apply to any operation between the Community and third countries; whereas it is necessary to ensure that such trade is subject to fiscal provisions equivalent to those which would be applied to operations carried out under the same conditions with territories which are not part of the Community customs territory; whereas as a result of these provisions the Seventeenth Council Directive 85/362/EEC of 16 July 1985 on the harmonization of the laws of the Member States relating to turnover taxes - Exemption from value added tax on the temporary importation of goods other than means of transport (4), becomes null and void;
Overwegende dat bepaalde gebieden die deel uitmaken van het douanegebied van de Gemeenschap, voor de toepassing van het gemeenschappelijk stelsel van de belasting over de toegevoegde waarde als derdelandsgebieden worden beschouwd; dat derhalve voor het handelsverkeer tussen de Lid-Staten en deze gebieden dezelfde beginselen inzake heffing van de belasting over de toegevoegde waarde gelden als voor handelingen tussen de Gemeenschap en derde landen; dat gewaarborgd dient te worden dat ten aanzien van dit handelsverkeer belastingvoorschriften kunnen worden gehanteerd die gelijkwaardig zijn met die welke van toepassing zouden zijn op handelingen die onder dezelfde voorwaarden worden verricht met derdelandsgebieden buiten het douanegebied van de Gemeenschap; dat derhalve Zeventiende Richtlijn 85/362/EEG van de Raad van 16 juli 1985 betreffende de harmonisatie van de wetgevingen van de Lid-Staten inzake omzetbelasting - Vrijstelling van belasting over de toegevoegde waarde bij de tijdelijke invoer van andere goederen dan vervoermiddelen (4) haar inhoud verliest;
