1. The Director and Deputy Directors appointed on the basis of Article 29 of the Europol Convention shall, for the remaining periods of their terms of office, be the Director and Deputy Directors within the meaning of Article 38 of this Decision.

The necessary arrangements concerning the accommodation to be provided for Europol in the headquarters State and the facilities to be made available by that State as well as the particular rules applicable in the Europol headquarters State to the Director, the members of the Management Board, the Deputy Directors, employees of Europol and members of their families shall be laid down in a Headquarters Agreement between Europol and the Kingdom of the Netherlands to be concluded once the approval of the Management Board has been obtained.

The members of the Management Board, the Director, the Deputy Directors, employees of Europol and liaison officers, as well as other persons under the obligation provided for in paragraph 2, shall not give evidence in or outside a court or make any statements on any facts or information which come to their knowledge in the performance of their duties or the exercise of their activities without reference to the Director or, in the case of the Director himself, to the Management Board.

1. National units, liaison officers, the Director, Deputy Directors and duly empowered Europol staff shall have the right to input data directly into the Europol Information System and retrieve them from it.

1. The members of the Management Board, the Director, the Deputy Directors, employees of Europol and liaison officers shall refrain from any action and any expression of opinion which might be harmful to Europol or prejudice its activities.

5. Should the Council decide not to remove the Director or Deputy Director concerned from his post in accordance with Article 9(1)(h) of Annex IX to the Staff Regulations or otherwise terminate his service at Europol, the matter shall be referred back to the Management Board in the case of the Director or to the Management Board and to the Director in the case of a Deputy Director.
5. Indien de Raad besluit de betrokken directeur of adjunct-directeur niet uit zijn functie te ontzetten overeenkomstig artikel 9, lid 1, onder h), van bijlage IX bij het Statuut noch zijn dienst bij Europol anderszins te beëindigen, wordt de zaak terugverwezen naar de raad van bestuur in geval van een directeur en naar de raad van bestuur en de directeur in geval van een adjunct-directeur.

4. Upon receipt of an opinion of the Management Board, as referred to in paragraphs 2 or 3 of this Article, the Council shall, after having heard the Director or Deputy Director concerned, decide whether to remove the Director or a Deputy Director from his post in accordance with Article 9(1)(h) of Annex IX to the Staff Regulations or otherwise terminate his service at Europol.
4. Na ontvangst van een advies van de raad van bestuur, zoals bedoeld in de leden 2 en 3 van het onderhavige artikel, besluit de Raad, na de betrokken directeur of adjunct-directeur te hebben gehoord, of de directeur of adjunct-directeur al dan niet uit zijn functie wordt ontzet overeenkomstig artikel 9, lid 1, onder h), van bijlage IX bij het Statuut dan wel of zijn dienstverband bij Europol anderszins wordt beëindigd.

1. Where the terms of office of the Director or a Deputy Director appointed under Article 38 of the Europol Decision can be extended in accordance with Articles 38(1) or 38(2) of the Europol Decision, the Management Board may decide to derogate from the procedure established in Chapter 2.
