It is clear from the objectives of the framework agreement on parental leave that the concept of ‘[r]ights acquired or in the process of being acquired’ in the framework agreement covers all the rights and benefits, whether in cash or in kind, derived directly or indirectly from the employment relationship, which the worker is entitled to claim from the employer at the date on which parental leave starts.
Uit de doelstellingen van de raamovereenkomst inzake ouderschapsverlof blijkt dat het begrip „verworven rechten of rechten in wording” uit de raamovereenkomst alle rechten en voordelen in geld of in nature omvat die direct of indirect uit de arbeidsverhouding voorvloeien en waarop de werknemer jegens de werkgever aanspraak kan maken op de datum van ingang van het ouderschapsverlof.

It is apparent from both the wording of Clause 2.6 and its context that that provision is intended to avoid the loss of or reduction in rights derived from an employment relationship, acquired or being acquired, to which the worker is entitled when he starts parental leave, and to ensure that, at the end of that leave, with regard to those rights, he will find himself in the same situation as that in which he was before the leave.

In this instance, in which the place of origin is considered to be the place where the goods are when the supply is effected or the transport commences, can one resolve the difficulties encountered today: - by taxable persons who carry out transactions in a Member State in which they are not established; - by the principal of an intra-Community processing operation when he supplies the goods (as raw materials or as a processed product) from the Member State in which processing has taken place; - with storage in a Member State other than that of establishment, or where goods are supplied directly from the place of storage; - with the supply of goods acquired in another Member State when the transport to the final acquirer begins in that Member State, in which the taxable person is not established; - in providing a simple form of tax treatment for chain transactions, given the taxation of all the intermediary transactions in the Member State in which the goods are located.

To this end: - Member States and/or social partners must take the necessary steps to protect workers against dismissal on the grounds of an application for, or taking of, parental leave; - at the end of parental leave, workers have the right to return to the same job or, if that is not possible, to an equivalent or similar job consistent with their employment contract or employment relationship; - rights acquired or in the process of being acquired by a worker on the date on which parental leave begins will be maintained as they stand until the end of parental leave.
Daartoe : - moeten de Lid-Staten en/of de sociale partners de nodige maatregelen nemen om de werknemers te beschermen tegen ontslag wegens het aanvragen of opnemen van ouderschapsverlof ; - heeft de werknemer na afloop van het ouderschapsverlof het recht terug te keren in zijn oude functie of, indien dat niet mogelijk is, in een gelijkwaardige of vergelijkbare functie die in overeenstemming is met zijn arbeidsovereenkomst of arbeidsverhouding ; - blijven de op de datum van ingang van het ouderschapsverlof door de werknemer verworven rechten of rechten in wording, ongewijzigd behouden tot het einde van het ouderschapsverlof.
