Activities which are not performed in return for a consideration, e.g. by the State or on its behalf in the framework of its missions in the social field (for instance, courses taught under the national education system or in an establishment of higher education which is financed essentially out of public funds) do not constitute economic activities (see Commission Staff Working Document ‘Guide to the application of the European Union rules on state aid, public procurement and the internal market to services of general economic interest, and in particular to social services of general interest’ (SEC(2010) 1545 final of 7.12.2010), notably points 6.1 to 6.3).

This is particularly important because the majority of common foreign and security policy missions, such as, in particular, the European Union’s monitoring mission in Georgia and EULEX in Kosovo, are politically sensitive.

In accordance with the principle of national procedural autonomy, there being no European Union rules to govern the matter, it is for the domestic legal system of each Member State to designate the courts and tribunals having jurisdiction and to lay down the detailed procedural rules governing actions for safeguarding rights which individuals derive from European Union law.
Overeenkomstig het beginsel van nationale procedurele autonomie is het bij gebreke van een desbetreffende regeling van de Unie een zaak van het interne recht van de afzonderlijke lidstaten om de bevoegde rechterlijke instanties aan te wijzen en de procesregels vast te stellen voor vorderingen in rechte die strekken tot bescherming van de rechten die de justitiabelen aan het recht van de Unie ontlenen.

It must be recalled that, in accordance with the principle of national procedural autonomy, in the absence of European Union rules governing the matter, it is for the domestic legal system of each Member State to designate the courts and tribunals having jurisdiction and to lay down the detailed procedural rules governing actions for safeguarding rights which individuals derive from European Union law (see, to that effect, Case 33/76 Rewe [1976] ECR 1989, paragraph 5; Case C-213/89 Factortame and Others [1990] ECR I-2433, paragraph 19; Case C‑312/93 Peterbroeck [1995] ECR I-4599, paragraph 12; and Case C-13/01 Safalero [2003] ECR I-8679, paragraph 49).

Welcomes the start of the ESDP Rule of Law Mission to Georgia; believes that the mission represents a step forward in relations between the EU and Georgia and could bring about the indispensable changes to help Georgia establish deeper and more effective relations with the EU and encourage it to endorse the objectives of the European Neighbourhood Policy;

Welcomes the start of the ESDP Rule of Law Mission to Georgia; believes that the mission represents a step forward in relations between the EU and Georgia and in the latter's progress towards establishing deeper and more effective relations with the EU and sharing the objectives of the European Neighbourhood Policy;
5. verwelkomt de start van de "rechtsstaatmissie" in Georgië in het kader van het EVDB; is van mening dat deze missie een stap voorwaarts betekent in de betrekkingen tussen de EU en Georgië en in de vooruitgang die Georgië kan boeken om intensievere en doeltreffendere betrekkingen met de EU tot stand te brengen en de doelstellingen van het Europese nabuurschapsbeleid over te nemen;
