in the pursuit of its mission to ‘ensure the safety of the food chain and the quality of foods with a view to protecting human, animal and plant health’, the AFSCA is acting not as a private operator but as a public authority and that, consequently, it is not in receipt of State aid; there is no economic bias in favour of economic operators covered by Agency activities financed by fees and that, consequently, they are not in receipt of aid; as regards the financing of general random checks by fixed contributions, the operators receive no specific economic advantage and, consequently, no aid, given the compulsory nature of the checks and the fact that they cannot be invoiced directly to an individual company as they aim to ensure that the entire food chain is monitored (they benefit all operators and aim to protect health and food safety in Belgium); using contributions to finance part of the cost of BSE tests and other checks linked directly to the production and placing on the market of certain products is a form of State aid which complies with the Guidelines on State aids linked to BSE tests; the actual financing mechanism contains no specific provisions which would be contrary to other provisions of the Treaty, and the parameters for distributing the sum of contributions among operators in the various sectors are objective and fair criteria which do not lead to discriminatory treatment as regards the origin of the products.
dat het FAVV bij de uitoefening van zijn taak, namelijk toezien op de veiligheid van de voedselketen en op de kwaliteit van levensmiddelen teneinde de gezondheid van mensen, dieren en planten te beschermen, niet optreedt als particuliere marktdeelnemer maar als overheidsinstantie en dat er derhalve geen sprake is van staatssteun; dat de uit retributies gefinancierde activiteiten van het agentschap geen economisch voordeel opleveren voor de betrokken marktdeelnemers en dat er bijgevolg geen sprake is van steun; dat de financiering van de algemene aselecte controles uit forfaitaire heffingen geen enkel specifiek economisch voordeel oplevert voor de marktdeelnemers en dat er derhalve ook geen sprake is van steun; de controles zijn namelijk verplicht en kunnen niet rechtstreeks aan individuele bedrijven worden gefactureerd omdat zij gericht zijn op het toezicht op de volledige voedselketen (de controles komen ten goede aan alle marktdeelnemers en hebben ten doel de bescherming van de volksgezondheid en de voedselveiligheid in België te garanderen); dat het gebruik van de heffingsopbrengsten voor de gedeeltelijke financiering van de kosten voor BSE-tests en andere verplichte controles die rechtstreeks betrekking hebben op de productie en/of de afzet, moet worden beschouwd als staatssteun overeenkomstig de communautaire richtsnoeren inzake staatssteun betreffende TSE-tests; dat het eigenlijke financieringssysteem geen bijzondere voorschriften bevat die strijdig zouden zijn met andere bepalingen van het Verdrag en dat de criteria voor de verdeling van de totale opbrengst van de heffingen over de marktdeelnemers uit de verschillende sectoren objectief en billijk zijn en geen elementen bevatten die kunnen leiden tot een discriminerende behandeling op basis van de herkomst van de producten.

40. Stresses that it is essential that the Commission coordinates its various departments including EMEA, the Food and Veterinary Office, the EFSA and National Food Agencies in order to ensure safety on the entire food chain, paying particular attention to possible loopholes related to the mandates of these different bodies; further clarification must be provided of the relationship between the JRC, the Scientific Committees and the Authority;
40. onderstreept dat het van essentieel belang is dat de Commissie voor coördinatie zorgt tussen haar diverse afdelingen, waaronder het EBGB, het Voedsel- en Veterinair Bureau, de EAV en de nationale instanties voor levensmiddelen, teneinde de veiligheid van de gehele voedselketen te waarborgen, waarbij met name gelet moet worden op eventuele hiaten die verband houden met de taakstelling van deze verschillende organen; er moet meer duidelijkheid komen omtrent de relatie tussen de Eenheid consumentenbescherming van het GCO, de wetenschappelijke comités en de EAV;

Considers that the national agencies should activate and coordinate a network of regional and/or interregional centres of excellence for food safety in universities and/or national research institutes, the aim of which is a continuous monitoring of food quality and security along the entire food chain;

Considers that the EFSA should ensure coordination, the creation of a network, and close cooperation with and between the national food safety agencies of Member States and should take steps to maintain close contacts both with the main consumer protection organisations and with representatives of the other parties involved in the food chain in order to promote exchanges of information on risk evaluation;
