Where the Member State in which the tied agent is established has decided, in accordance with paragraph 1, not to allow the investment firms authorised by their competent authorities to appoint tied agents, those tied agents shall be registered with the competent authority of the home Member State of the investment firm on whose behalf it acts.

Member States shall require that investment firms appointing tied agents take adequate measures in order to avoid any negative impact that the activities of the tied agent not covered by the scope of this Directive could have on the activities carried out by the tied agent on behalf of the investment firm.
4. Ministers meeting at the General Affairs Council in Luxembourg on 28-29 October have decided to appoint as the EU's envoy to the Peace Process Ambassador Miguel Angel Moratinos, who would have the following mandate: - to establish and maintain close contact with all the parties to the Peace Process, other countries of the region, the US and other interested countries, as well as relevant international organisations, in order to work with them in strengthening the Peace Process; - to observe peace negotiations between the parties, and to be ready to offer the EU's advice and good offices should the parties request this; - to contribute where requested to the implementation of international agreements reached between parties, and to engage with them diplomatically in the event of non-compliance with the terms of these agreements; - to engage constructively with signatories to agreements within the framework of the Peace Process in order to promote compliance with the basic norms of democracy, including respect for human rights and the rule of law; - to report to the Council's bodies on the possibilities for EU interventions in the Peace Process, and on the best way of pursuing EU initiatives and ongoing MEPP-related EU business including the political aspects of relevant EU development projects; - to monitor actions by either side which might prejudice the outcome of the permanent status negotiations.
De Ministers, in het kader van de Raad (Algemene Zaken) op 28/29 oktober in Luxemburg bijeen, hebben besloten als EU-gezant voor het vredesproces Ambassadeur Miguel Angel Moratinos te benoemen, wiens mandaat het volgende zou inhouden : - nauwe contacten te leggen en te onderhouden met alle partijen bij het vredesproces, andere landen in de regio, de VS en andere belanghebbende landen, alsook betrokken internationale organisaties, ten einde samen met hen te werken aan de versterking van het vredesproces ; - als waarnemer de vredesonderhandelingen tussen de partijen te volgen en bereid te zijn het advies en de goede diensten van de EU aan te bieden wanneer partijen hierom zouden verzoeken ; - desgevraagd bij te dragen tot de tenuitvoerlegging van internationale overeenkomsten die partijen hebben bereikt, en op het diplomatieke vlak met hen in contact te treden ingeval men zich niet houdt aan de voorwaarden van deze overeenkomsten ; - constructieve gesprekken te voeren met partijen bij de overeenkomsten in het kader van het vredesproces ten einde de inachtneming van de basisnormen van democratie te bevorderen, waaronder de eerbiediging van de mensenrechten en van de rechtsstaat ; - verslag uit te brengen aan de Raadsinstanties over de mogelijkheden voor EU-interventie in het vredesproces, en over de wijze waarop EU- initiatieven in het vredesproces en lopende EU-activiteiten in verband met het vredesproces in het Midden-Oosten, waaronder de politieke aspecten van daarmee samenhangende ontwikkelingsprojecten van de EU, het best kunnen worden aangepakt ; - toe te zien op acties van beide partijen die het resultaat van de onderhandelingen betreffende de permanente status nadelig zouden kunnen beïnvloeden.
