TRADUCTIONS EN CONTEXTE

The application of this Regulation should be without prejudice to the Member States’ obligations and rights over the high seas, in accordance with Article 12 of the Chicago Convention, and in particular with Annex 2 to the Chicago Convention, as well as the obligations of Member States and the Union under the United Nations Convention on the Law of the Sea and the obligations of Member States under the Convention on the International Regulations for Preventing Collisions at Sea, 1972.

1. Condemns Turkey’s constant violations of international law against the Republic of Cyprus, on this occasion of the Law of Sea, including both UNCLOS and the customary international Law of the Sea;

to commend the creation of the Malaysian Maritime Enforcement Agency (MMEA) combining all law enforcement activities of federal laws at sea in one agency; to commend the results of Malaysia’s subregional cooperation with Singapore, Indonesia, the Philippines, Thailand, the Asia Maritime Security Initiative (Amarsective) and the Regional Cooperation Agreement on Combating Piracy and Armed Robbery Against Ships in Asia (ReCAAP), and of cooperation within the ASEAN Regional Forum (ARF), in significantly improving maritime security in both the Malacca Strait, through which more than 50 000 vessels pass annually, and Malaysia’s coastal waters; to express appreciation for the fact that the Malaysian Armed Forces have taken part in the anti-piracy operations off the Somali coast; sees potential for closer EU-Malaysian cooperation in enhancing maritime security, in particular in coast guard capacity-building, information sharing, naval interoperability and the development of legal aspects;

Recalls its serious concerns over the tension in the South China Sea; considers it regrettable that, contrary to the 2002 Declaration of Conduct, several parties are claiming land in the disputed waters; is particularly concerned at the massive scale of China’s current activities in the area, including building military facilities, ports, and at least one airstrip; urges all parties in the disputed area to refrain from unilateral and provocative actions and to resolve the disputes peacefully based on international law, in particular the UNCLOS, with impartial international mediation and arbitration; urges all parties to acknowledge the jurisdiction of both UNCLOS and the Court of Arbitration, and calls for respect for any eventual decision by UNCLOS; supports all steps that will enable the South China Sea to become a ‘sea of peace and cooperation’; also supports all endeavours to ensure that the parties agree on a code of conduct for the peaceful exploitation of the maritime areas in question, including the establishment of safe trade routes, and encourages confidence-building measures; believes that the EU should engage in bilateral and multilateral cooperation in order to effectively contribute to security in the region.

During border surveillance operations at sea, Member States should respect their respective obligations under international law, in particular the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the United Nations Convention against Transnational Organized Crime and its Protocol against the Smuggling of Migrants by Land, Sea and Air, the United Nations Convention relating to the Status of Refugees, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the International Covenant on Civil and Political Rights, the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the United Nations Convention on the Rights of the Child and other relevant international instruments.

For the purposes of protecting the Community financial interest and securing the overriding interest in the conservation of fisheries resources, the financial assistance in the framework of Council Regulation (EC) No 1198/2006 of 27 July 2006 on the European Fisheries Fund and Council Regulation (EC) No 861/2006 of 22 May 2006 establishing Community financial measures for the implementation of the common fisheries policy and in the area of the Law of Sea should be made conditional upon compliance by Member States with their obligations in the fields of fisheries control and thus suspension and cancellation of such financial assistance should be foreseen in cases of an inadequate implementation of the rules of common fisheries policy by Member States which affects the effectiveness of the measures being financed.
Met het oog op de bescherming van de financiële belangen van de Gemeenschap en om het bijzondere belang in het behoud van visserijhulpbronnen te verzekeren, moet de financiële steun die wordt verleend krachtens Verordening (EG) nr. 1198/2006 van de Raad van 27 juli 2006 inzake het Europees Visserijfonds en Verordening (EG) nr. 861/2006 van de Raad van 22 mei 2006 houdende communautaire financieringsmaatregelen voor de tenuitvoerlegging van het gemeenschappelijk visserijbeleid en op het gebied van het zeerecht afhankelijk gemaakt worden van het naleven door de lidstaten van hun verplichtingen op het gebied van visserijcontrole. Als de lidstaten de regels van het gemeenschappelijk visserijbeleid niet op toereikende wijze ten uitvoer leggen en dit afbreuk doet aan de doeltreffendheid van de financieel ondersteunde maatregelen, moeten schorsing en verval van deze financiële steun mogelijk zijn.

The proposal aims to provide a more transparent and simplified framework for the execution of Community financial interventions. It is geared towards improving the effectiveness of financial interventions in the field of control and enforcement, in the area of data collection and scientific advice, in the strengthening of the governance of the common fisheries policy, and in the area of international relations and the Law of the Sea.
Het voorstel beoogt een transparanter en eenvoudiger kader te scheppen voor de uitvoering van financiële interventies door de Gemeenschap teneinde de doelmatigheid van financiële interventies te verbeteren op het gebied van controle en handhaving, gegevensverzameling en wetenschappelijk advies, een beter bestuur van het gemeenschappelijk visserijbeleid, en de internationale betrekkingen en het zeerecht.

In recent years, they have acquired a higher profile in the context of the international law of the sea. It is recognised by the UN Convention on the Law of the Sea of 10 December 1982 and the New York Agreement of 4 August 1995 that RFOs are the best means of guaranteeing fish resource management at world level.
