In the present case, although it is clear from the pleas and forms of order set out above that the applicant is the unsuccessful party and that the Commission has applied for her to be ordered to bear the costs, it is also apparent that although the applicant had asked on several occasions for information about her, concerning her written tests (b) and (c), following the procedure laid down in Section D.4 of the notice of competition, and had received several communications from EPSO stating that the documents requested were attached to them, EPSO did not grant the request for information until 16 June 2010, that is to say, when the applicant had already lodged her application.
In casu volgt uit de hierboven genoemde rechtsoverwegingen en conclusies weliswaar dat verzoekster in het ongelijk is gesteld en dat de Commissie heeft gevraagd om haar in de kosten te verwijzen, doch hieruit blijkt eveneens dat EPSO, ofschoon verzoekster herhaaldelijk om toezending van op haar betrekking hebbende informatie over haar schriftelijke examens b) en c) had gevraagd, waarbij zij de procedure van titel D, punt 4, van de aankondiging van vergelijkend onderzoek had gevolgd, en verschillende berichten van EPSO had gekregen volgens welke de gevraagde stukken daarbij waren gevoegd, pas op 16 juni 2010 heeft voldaan aan het verzoek om toezending van informatie, dat wil zeggen nadat verzoekster haar verzoekschrift had ingediend.

In response to those measures of organisation of procedure, by letter received at the Tribunal Registry on 18 February 2008, the Commission sent to the Tribunal, as called for in point (c) of the preparatory report for the hearing, a table, without names, of the eliminatory marks of the candidates who had failed the oral test. However, the Commission failed to produce the items indicated under points (a), (b) and (d) of that report, contending in essence that, in the absence of proof of infringement of the rules governing the proceedings of the selection board, the plea in law concerning the statement of reasons alone did not justify, having regard to the secrecy of the proceedings of the selection board, the production of the other information and documents requested.
In antwoord op deze maatregelen tot organisatie van de procesgang heeft de Commissie bij op 18 februari 2008 ter griffie van het Gerecht voor ambtenarenzaken binnengekomen schrijven een geanonimiseerde tabel toegezonden met de onvoldoendes van de kandidaten die niet waren geslaagd voor het mondeling examen, zoals gevraagd in het rapport ter voorbereiding van de terechtzitting, sub c.
