In April 2000, the European Ombudsman proposed to the institutions a Code of Good Administrative Behaviour in the belief that the same code should apply to all Union institutions, bodies, offices and agencies.

In its resolution of 6 September 2001, Parliament approved the European Ombudsman’s draft code with modifications and called on the Commission to submit a proposal for a regulation containing a Code of Good Administrative Behaviour based on Article 308 of the Treaty establishing the European Community.

In support of the action as a whole, the applicant raises a number of pleas: first, breach of the right of candidates to have access to certain information concerning them; second, breach of the obligation to state reasons and of the Commission’s code of good administrative behaviour; third, breach of the principle of transparency; and fourth, breach of the principle of equal treatment.

EPSO also acted in breach of the Annex to the Commission Decision of 17 October 2000 amending its Rules of Procedure (OJ 2000 L 267, p. 63), entitled ‘Code of good administrative behaviour for staff of the European Commission in their relations with the public’ (‘the code of good administrative behaviour’), under which the Commission must reply to a letter addressed to it within 15 days, and a Commission decision must clearly state the reasons on which it is based and be communicated to the persons and parties concerned.
EPSO heeft eveneens gehandeld in strijd met de bijlage bij het besluit van de Commissie van 17 oktober 2000 tot wijziging van haar reglement van orde (PB L 267, blz. 63), genaamd „Bestuurlijke gedragscode voor het personeel van de Europese Commissie bij de contacten met het publiek” (hierna: „bestuurlijke gedragscode”), op grond waarvan de Commissie tot haar gerichte verzoeken binnen twee weken moet beantwoorden en elk besluit van die instelling duidelijk de redenen moet aangeven waarop het is gebaseerd, en ter kennis van de betrokken personen en partijen moet worden gebracht.

In order to enable the Commission to meet its obligations of good administrative behaviour and in particular in the dealings that the Commission has with the public, the Commission undertakes to observe the standards of good administrative behaviour set out in this Code and to be guided by these in its daily work.
Om te voldoen aan haar verplichtingen inzake goed bestuurlijk gedrag, in het bijzonder in de contacten met het publiek, verplicht de Commissie zich ertoe de in deze code vervatte bestuurlijke gedragsnormen na te leven en deze als leidraad te nemen in haar dagelijkse werkzaamheden.
