The EEAS was established by the Lisbon Treaty and is based on Article of the Treaty on European Union.

(39)Since the objectives of this Regulation, namely the development and implementation of a system of integrated management of the external borders, thus also ensuring the proper functioning of the Schengen area, cannot be sufficiently achieved by the Member States acting in an uncoordinated manner but can rather, because of the absence of controls at internal borders and in view of the significant migratory pressures at the external borders and the need to safeguard a high level of internal security within the Union, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article of the Treaty on European Union.

The revision procedures are described in Article of the Treaty on European Union. Whatever procedure is followed, EU countries must unanimously agree on the revision of the Treaty provisions concerned.

The 17th and 18th recitals in the preamble to the directive explain that, in accordance with (i) the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, and without prejudice to Article 4 of this Protocol, and (ii) the Protocol on the position of Denmark annexed to those Treaties, these Member States did not participate in the adoption of the directive and are not bound by or subject to its application.
