The solution to this problem was to have inserted in the ISPA Regulation a provision allowing in accordance with Article 114 2 of the Financial Regulation applicable to the general budget of the European Communities, that in exceptional cases, nationals of third countries may participate in tenders on projects receiving external aid financed from the Community Budget.

14. Recognises the need to reform the current system but considers that this issue should form part of a more global reflection between the two arms of the budgetary authority on the various possible sources of finance for the EU budget; this should take place at the highest political levels, should not give rise to disparities in treatment between the Member States and should take into account national considerations and the different proposals made at Community level, including the Parliament's proposals put forward in recent resolutions;

6. In the methods of budget implementation referred to in paragraphs 3 and 4, the Member States and third countries shall conduct regular checks to ensure that the actions to be financed from the Community budget have been implemented correctly.

They shall place at the disposal of the Court of Auditors all documents concerning the award and performance of contracts financed by the Community budget and all accounts of cash or materials, all accounting records or supporting documents, and also administrative documents relating thereto, all documents relating to revenue and expenditure, all inventories, all organisation charts of departments, which the Court of Auditors considers necessary for auditing the budgetary and financial outturn report on the basis of records or on the spot and, for the same purposes, all documents and data created or stored on a magnetic medium.

In the case of shared management referred to in the first subparagraph, the beneficiary country shall agree to assume full responsibility for the Community funds paid to it. It shall also undertake to conduct regular checks to ensure that the actions financed from the Community budget have been implemented correctly, to prevent and prosecute irregularities and fraud and to recover funds lost, wrongly paid or incorrectly used.
