The observations on the opening decision submitted by the other three third parties, i.e. HPI, INEKO and ZZP are mainly supportive of the position of the complainant Dôvera and Union Health Insurance that the activity is of an economic nature and the measures involve State aid by providing SZP/VZP with a selective advantage, showing their conviction that health insurers are operating in a competitive environment (by using different ways to attract clients) and claiming that the State has given preferential treatment to its State-owned health insurance companies.

To further support their claim that the activity of compulsory health insurance does not fall under competition rules, the authorities also draw attention to a 2009 investigation by the Slovak Antimonopoly Office which revealed that the activities by health insurance companies are performed within a system characterised by a high degree of solidarity where healthcare is provided free of charge and the essential elements of such activities are regulated by the State and that, therefore, the activities carried out by health insurance companies in the provision of public health insurance cannot be regarded as an economic activity by undertakings which restricts competition. Hence, according to the Antimonopoly Office, the Slovak Competition Act does not apply to the activities of health insurance companies carried out in the provision of public health insurance (36).

(42) Derogating from the prohibition on processing sensitive categories of data should also be allowed if done by a law, and subject to suitable safeguards, so as to protect personal data and other fundamental rights, where grounds of public interest so justify and in particular for health purposes, including public health and social protection and the management of health-care services, especially in order to ensure the quality and cost-effectiveness of the procedures used for settling claims for benefits and services in the health insurance system, or for historical, statistical and scientific research purposes.
(41) Er dient ook van het verbod op de verwerking van categorieën gevoelige gegevens te kunnen worden afgeweken, indien de wet hierin voorziet en er passende waarborgen worden geboden ter bescherming van persoonsgegevens en andere grondrechten, op grond van een zwaarwegend algemeen belang en in het bijzonder voor gezondheidsdoeleinden, zoals volksgezondheid en sociale bescherming en het beheer van gezondheidsdiensten, met name om de kwaliteit en kostenefficiëntie te waarborgen van de procedures voor de afwikkeling van aanvragen voor uitkeringen en diensten in het kader van de ziektekostenverzekering of voor historisch, statistisch en wetenschappelijk onderzoek.

Considers, therefore, that ensuring legal certainty as regards the reimbursement of the costs for cross-border healthcare is one of the priority issues for both patients, national health insurance systems and healthcare providers; underlines the need to clarify procedures and conditions for reimbursement in various cases;

That is very true. Yet we must not end up by opposing patients, states and health insurance systems because any destabilisation of health insurance systems would have dreadful repercussions on the organisation of healthcare and, specifically, on the patients we want to protect.
Dat is natuurlijk waar, maar anderzijds mogen patiënten, overheden en ziekteverzekeringsstelsels niet tegenover elkaar komen te staan, want een destabilisering van de ziekteverzekeringsstelsels zou verschrikkelijke gevolgen hebben voor de organisatie van de gezondheidszorg en vooral voor de zieken die wij juist willen beschermen.

In order to avoid disruption of the market, it is therefore appropriate to submit claims referring to children's development and health to the same transitional measures as the other health claims.

The term ‘application’ hereafter means a stand-alone dossier containing the information and the scientific data submitted for authorisation of the health claim in question.

Calls for examination of ways of actively supporting and promoting the work aimed at making use of the European Health Insurance Card with a standardised set of electronic patient data common practice, in order to simplify the procedures for European citizens obtaining health care in other Member States and to ensure confidentiality of sensitive medical data; considers that the holders of the card have to decide themselves the data which will appear on it; to make the most effective use of this system, calls for the adoption of European health indicators; considers that it is crucial, for patient safety reasons, to encourage national authorities to exchange information on registration and disciplinary matters relating to health-care providers operating across borders; believes that it is appropriate to expand the European health insurance card scheme to include a system of international exchange of data concerning the insurance status of the patient;

H. whereas the European Court of Justice has repeatedly recognised claims by patients for the reimbursement of the costs of medical treatment in another Member State, although it has made a distinction between in-patient and out-patient treatment, attaching certain conditions to the assertion of such claims, which are intended in particular to ensure a balanced approach and social security, always with the objective of ensuring a high standard of health protection,
