For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Met het oog op deze hogere voorziening moet in de eerste plaats worden opgemerkt dat het Gerecht voor ambtenarenzaken eraan heeft herinnerd dat elk individueel besluit dat overeenkomstig het Ambtenarenstatuut wordt genomen en dat bezwarend is, met redenen moet worden omkleed, en dat de motiveringsplicht tot doel heeft, enerzijds de rechter in staat te stellen toezicht uit te oefenen op de wettigheid van het besluit en anderzijds aan de betrokkene de noodzakelijke gegevens te verschaffen om uit te maken of het besluit al dan niet gegrond is en hem in staat te stellen te beoordelen of het instellen van beroep opportuun is. Onder verwijzing naar het arrest van het Hof van 4 juli 1996, Parlement/Innamorati (C‑254/95 P, Jurispr. blz. I‑3423, punten 24‑28), heeft het hier echter aan toegevoegd dat, wat de besluiten van een jury van een vergelijkend onderzoek betreft, de motiveringsplicht in overeenstemming moet worden gebracht met de eerbiediging van het in artikel 6 van bijlage III bij het Ambtenarenstatuut geformuleerde beginsel volgens hetwelk de werkzaamheden van de jury geheim zijn, welk geheim is ingevoerd teneinde de onafhankelijkheid en onbevangenheid van de jury’s te waarborgen. De eerbiediging van dit geheim brengt dus mee dat de opvattingen van de individuele juryleden niet ruchtbaar mogen worden en dat gegevens, verband houdende met beoordelingen, de kandidaten persoonlijk dan wel in vergelijking met andere kandidaten betreffende, niet aan de openbaarheid mogen worden prijsgegeven, alsook dat het vereiste van motivering van de besluiten van de jury van een vergelijkend onderzoek rekening moet houden met de aard van de betrokken werkzaamheden die, in de fase van het onderzoek naar de bekwaamheden van de kandidaten, vooral vergelijkend van aard zijn en derhalve worden gedekt door het geheim van die werkzaamheden (punten 30 en 31 van het bestreden arrest).

3. Without prejudice to requirements of national criminal law, the competent authorities, bodies or natural or legal persons other than competent authorities which receive confidential information pursuant to this Directive or to Regulation (EU) No ./. [MiFIR] may use it only in the performance of their duties and for the exercise of their functions, in the case of the competent authorities, within the scope of this Directive or of Regulation (EU) No ./. [MiFIR] or, in the case of other authorities, bodies or natural or legal persons, for the purpose for which such information was provided to them and/or in the context of administrative or judicial proceedings specifically related to the exercise of those functions.

By its legal nature, this Decision can only be seen as a non-binding framework for future legislation: however, it should be emphasised that by agreeing to it, the co-legislator must live up to his commitment and implement future pieces of legislation accordingly

By their nature, framework decisions are binding upon the Member States as to the result to be achieved, but it is a matter for the national authorities to choose the form and method of implementation (the criteria are: clarity, legal certainty, effectiveness).
