7. Calls for the inclusion in the Common Position of the post-embargo toolbox which should integrate or initiate the following aspects: (a) regular assessments, also involving relevant EU units and working groups other than COARM, as well as national governments and authorities, with the aim of clarifying whether the EU should reimpose an embargo, continue to keep it under special measures, or further normalise controls, (b) operate a policy of presumption of denial to the ex-embargo state, (c) apply the equivalent of the existing denial notification/consultation mechanism with regard to all potential transfers to the formerly embargoed state, (d) states to report on individual transfers for inclusion in the Consolidated Report, (e) Member States must reserve the right to undertake post‑transfer inspections for end-use verification purposes, and (f) the end-use control on dual-use items to states under embargo should be extended to include these states;

Favours preserving and simplifying the system of Traditional Speciality Guaranteed expresses disappointment at the performance of this instrument, under which so far only a small number of TSGs have been registered (20, with 30 applications pending); stresses that the register of TSGs mentioned second in Article 3(2) of Council Regulation (EC) No 509/2006 of 20 March 2006 on agricultural products and foodstuffs as traditional specialities guaranteed – the register in which the name of the product or foodstuff is not reserved to the producers – should be abolished since this weakens TSG protection; recalls that the TSG system remains a useful instrument for protection of the networks and that it offers substantial room for development provided certain conditions are met;

The new Member States shall use the national reserve for the purpose of allocating, according to objective criteria and in such a way as to ensure equal treatment between farmers and to avoid market and competition distortions, payment entitlements to farmers finding themselves in a special situation, to be defined by the Commission in accordance with the procedure referred to in Article 144(2).

During the first year of application of the single payment scheme, the new Member States may use the national reserve for the purpose of allocating payment entitlements, according to objective criteria and in such a way as to ensure equal treatment between farmers and to avoid market and competition distortions, to farmers in specific sectors, finding themselves in a special situation as a result of the transition to the single payment scheme.
3. Gedurende het eerste toepassingsjaar van de bedrijfstoeslagregeling kunnen de nieuwe lidstaten de nationale reserve gebruiken om op basis van objectieve criteria en op zodanige wijze dat een gelijke behandeling van de landbouwers wordt gewaarborgd en markt- en concurrentieverstoringen worden voorkomen, toeslagrechten toe te kennen aan landbouwers in specifieke sectoren die zich in een bijzondere situatie bevinden als gevolg van de overgang naar de bedrijfstoeslagregeling.
