On 3 March 2010 Hong Kong completed the legislative process for the enactment of the law and provisions on exchange of information in accordance with the 2004 version of the OECD Model Tax Convention.

In conclusion, your rapporteur recommends to consent to the Council Decision allowing Member States to ratify or accede to the Hong Kong Convention as a step at global level to move towards safer and more environmentally sound recycling of non-EU ships, while insisting that truly safe and environmentally sound recycling is only achieved by going beyond the provisions of the Hong Kong Convention as adopted in the new EU Regulation on Ship Recycling.

In light of the far weaker standards of the Hong Kong Convention for ship recycling facilities, and the fact that the Hong Kong Convention does not address the treatment of waste outside the ship recycling facility, all facilities that are authorized by the Parties to the Hong Kong Convention need to be assessed against the provisions of this Regulation if they want to be included in the European List.
