Lawson en Schermers stellen in hun commentaar op een van de mijlpaalarresten van het EHRM, met name S.W. versus Groot-Brittannië van 22 november 1995, het volgende (4) : « Expanding upon the reference in Article 7 § 1 of the European Convention on Human Rights to « crimes .under international law », paragraph 2 of Article 7 makes it possible to punish a person for an act which, at the time it was committed, was « criminal according to the general principles of law recognised by civilised nations », even though it was not classified as a criminal offence under national law.
