In this respect also, sharing the concern of the Parliament to reinforce the conditions to combat fraud and irregularities which are already foreseen in Annex III. 4 of the Financing Memorandum, the Commission has revised this annex in 2002 to align it more closely with the provisions of the Commission Regulation (EC) No. 1386/2002 of 29 July 2002 laying down detailed rules as regards the management and control system for assistance granted from the Cohesion Fund and the procedure for making financial corrections to such assistance.
À cet égard également, partageant la préoccupation du Parlement de renforcer les modalités de lutte contre la fraude et les irrégularités, qui sont déjà prévues à l'annexe III. 4 du protocole de financement, la Commission a procédé à la révision de l'annexe concernée en 2002, dans le but de la rapprocher plus étroitement des dispositions du règlement (CE) n° 1386/2002 de la Commission du 29 juillet 2002 qui stipule les règles détaillées appliquées aux systèmes de gestion et de contrôle de l'utilisation des aides octroyées par le Fonds de cohésion et la procédure utilisée pour les corrections financières à apporter à ces aides.

29. Calls on the Member States to ensure sufficient gas supply through reverse gas flow from neighbouring states in the EU; welcomes, to this end, the memorandum of understanding on reverse flows between the Slovak Republic and Ukraine, which should encourage Ukraine to establish a transparent and reliable gas transportation system; recalls the strategic role of the Energy Community, of which Ukraine holds the presidency in 2014; welcomes the fact that cooperation with Ukraine forms an integral part of the Commission’s European Energy Security Strategy presented in June 2014;
29. demande aux États membres de garantir un approvisionnement en gaz suffisant par le biais d'un système d'écoulement inverse depuis les États membres voisins; se félicite, à cet égard, du protocole d'entente sur l'écoulement inverse signé entre la Slovaquie et l'Ukraine, qui devrait avoir pour effet d'encourager l'Ukraine à mettre en place un système d'acheminement du gaz transparent et fiable; rappelle le rôle stratégique de la Communauté de l'énergie, dont l'Ukraine assure la présidence en 2014; se félicite de ce que la coopération avec l'Ukraine fasse partie intégrante de la stratégie de l'Union pour la sécurité énergétique présentée par la Commission en juin 2014;

1. The Member States shall provide that the activities listed in Annex I may be carried on within their territories, in accordance with Articles 25, 26(1) to (3), 28(1) and (2) and 29 to 37, either by the establishment of a branch or by way of the provision of services, by any financial institution from another Member State, whether a subsidiary of a credit institution or the jointly-owned subsidiary of two or more credit institutions, the memorandum and Articles of association of which permit the carrying on of those activities and which fulfils each of the following conditions:

29. Rejects the draft memorandum of understanding in which a code of practice for the exchange of information between OLAF and the Commission is set out, because it impinges upon the Regulation currently in force and, therefore, on OLAF's remit; believes that the provisions governing the forwarding of information should perhaps be reviewed in the context of a revised regulation; insists that the notification of OLAF should be enshrined in the Statute pursuant to Article 2 of the standard decision; insists that the head of OLAF should determine the content of the information, taking as criteria the protection of the rights of the person concerned, the need for an effective and efficient investigation to be carried out and the need for the EU institutions to be protected against any financial loss in future; calls on the Commission and OLAF to check whether it would be worthwhile to create the post of a legal officer; considers that each EU institution should lay down rules governing the way in which it deals with information received from OLAF, ensuring that it respects these criteria;
29. rejette le projet de mémorandum d'accord prévoyant l'établissement d'un code de pratique pour l'échange d'informations entre l'OLAF et la Commission, estimant qu'un tel code est contraire à la réglementation actuellement en vigueur et, partant, porte atteinte aux compétences de l'OLAF; estime que les dispositions qui régissent la communication d'informations devraient éventuellement être réexaminées dans le contexte d'un règlement révisé; insiste pour que l'obligation d'informer l'OLAF soit inscrite dans le statut des fonctionnaires, conformément à l'article 2 de la "décision modèle"; insiste pour que le directeur de l'OLAF détermine le contenu des informations en prenant pour critères la protection des droits de la personne concernée, la nécessité de conduire une enquête efficace et effective et le besoin de protéger les institutions de l'Union européenne contre d'éventuelles pertes financières à l'avenir; invite la Commission et l'OLAF à examiner l'opportunité de créer un poste d'avocat-conseil; estime qu'il appartient à chaque institution de l' Union de réglementer en toute autonomie la manière dont elle traite les informations transmises par l'OLAF, en garantissant le respect des critères définis;
