On 30 November 1994 the Commission decided to initiate the procedure provided for in Article 6 (4) of Decision No 3855/91/ECSC (Steel Aid Code) with respect to a series of loans totalling DM 49,825 million (ECU 26,53 million) which Bavaria granted between March 1993 and August 1994 to Neue Maxhütte Stahlwerke GmbH (hereinafter referred to as 'NMH`).

The amount of DM 49,895 million granted as loans by Bavaria in ten tranches between March 1993 and August 1994 to the ECSC steel undertaking Neue Maxhütte Stahlwerke GmbH, Sulzbach-Rosenberg, constitutes State aid incompatible with the common market and prohibited under the provisions of the ECSC Treaty and Decision No 3855/91/ECSC.

Having regard to Commission Decision No 3855/91/ECSC of 27 November 1991 establishing Community rules for aid to the steel industry (1),

The Commission has therefore decided to extend the proceedings initiated on 8 July 1992 under Article 6(4) of Decision 3855/91/ECSC so as to cover the aid arising from the proposal to relieve Ilva of the bulk of its indebtedness under a plan for restructuring the Italian public steel industry and the credit facility from which Ilva benefits.
Dès lors, la Commission a décidé d'étendre la procédure ouverte le 8 juillet 1992 conformément à l'article 6.4 de la décision 3855/91/CECA, à l'encontre des aides découlant de la libération de la plus grande partie de l'endettement du groupe ILVA dans le cadre d'un plan de restructuration de la sidérurgie publique italienne et à la facilité de crédit dont bénéficie ILVA.

The Commission's decision to approve these aid schemes is based on Article 5 of Decisions Nos 322/89/ECSC and 3855/91/ECSC (rules for aid to the steel industry), which provides that assistance granted under these schemes may be regarded as compatible with the common market provided that the aid is accompanied by a reduction in the overall production capacity of the territory of the former GDR.
La Décision de la Commission d'approuver ces aides est basé sur l'art. 5 des décisions 322/89/CECA et 3855/91/CECA (Code des Aides à la sidérurgie) qui prévoient la compatibilité de ces aides avec le marché commun à condition qui l'aide soit accompagnée d'une réduction de l'ensemble de la capacité de production du territoire de l'ex-RDA.

The Commission examined the compatibility of these aids with the provision of Article 4(1) of Decision no 3855/91/ECSC of 27.11.1991 (Steel Aids Code) on closure aid to steel undertakings and has found that the aids are in compliance with the conditions laid down in the Code, and that they do not exceed the maximum ceiling allowed for under these provisions.
La Commission a examiné la compatibilité de ces aides avec les dispositions de l'article 4 paragraphe 1 de la décision n° 3855/91/CECA du 27 novembre 1991 (Code des aides à la sidérurgie) relatif aux aides à la fermeture destinées à des entreprises sidérurgiques, et a conclu que les aides en question sont conformes aux conditions prévues dans le Code et qu'elles ne dépassent pas le plafond autorisé par ces dispositions.
