Notes that the implementation of the internal control system was not yet complete in 2005 and that the Governing Board had not adopted any internal control standards; deplores the fact that there is no risk analysis and no checklists to meet the needs of authorising officers and staff who perform operational checks; invites the Agency to tackle these issues in the interests of transparency and efficiency;

IS ENCOURAGED by the positive, forward-looking contributions made in discussions on future action to tackle climate change at the UNFCCC Seminar of Governmental Experts in May 2005; WELCOMES the commitment of the G8 countries to moving forward the global discussion on long-term co-operative action to address climate change at the UN Climate Change Conference in Montreal in December 2005. RECOGNISES that Article 3(9) of the Kyoto Protocol provides that the first Conference of the Parties serving as the Meeting of the Parties to the Protocol shall initiate the consideration of further commitments to be undertaken by developed countries at least seven years before the end of the first commitment period; and STRESSES that the COP/MOP should therefore initiate such considerations at its first meeting in December 2005 in Montreal; RECALLS also that Article 9 provides for a first review of the Kyoto Protocol at the second session of the Conference of the Parties serving as the meeting of the Parties to the Protocol, and that this review is to be coordinated with pertinent reviews under the United Nations Framework Convention on Climate Change. In preparing for COP 11 - COP/MOP 1, LOOKS FORWARD to initiating a process among all Parties to the United Nations Framework Convention on Climate Change to explore how further to implement this Convention to achieve its ultimate objective by developing a post 2012 arrangement, building on the experiences to date in tackling climate change, including inter alia market-based instruments, focusing in particular on environmental effectiveness, improving cost-efficiency, broadening participation in line with common but differentiated responsibilities and respective capabilities, advancing development goals in a sustainable manner, building a global carbon market, exploiting the full potential of existing technologies and exploring new ones as well as tackling adaptation; and STRESSES the need for a clear timetable for such a process, ...

STRESSES the importance of adopting a concrete Strategic Plan for the CBD at COP 6 and in this regard, NOTES with concern that although the recommendation of the Open-Ended Inter-Sessional Meeting on the Strategic Plan, National Reports and Implementation of the Convention on Biological Diversity (MSP) contains very important elements, the proposed approach and structure are not very strategic and that many crucial issues are still unresolved;

Nevertheless, I should like to tell you that, at the Ghent Summit and, of course, at the request of the presidency of the European Union, the Commission has undertaken work on examining this issue in all its aspects and, therefore, on listing laboratories, in an attempt to see what type of response we can provide. At the Commission meeting yesterday, a joint briefing sheet was issued by Mr Byrne, the Commissioner responsible for Health and Consumer protection, to Mr Liikanen and myself, to see how we can implement, at European Union level, in agreement, of course with the Member States, closer coordination in order to achieve our objectives, without necessarily creating an Agency.

For this the Council suggests the CoP considers the possibility of establishing ad-hoc small issue-based panels; consider the way the CBD inter-relates with major groups, given the latter's importance to effective implementation of the Convention at all levels.

The extent and development of such a cooperation will depend on Libya's commitments on asylum and fundamental rights as stated above; invites the Commission to engage, on the basis of the suggestions contained in the Annex and as soon as possible, in exploratory discussions with the Libyan authorities to identify practical measures to tackle illegal migration in areas such as training, reinforcement of institution building, asylum issues and increasing public awareness of the dangers of illegal migration, and to discuss the conditions under which such cooperation could take place; invites the Commission to report on the outcome of its exploratory discussions with the Libyan authorities in order for the Council to consider further action; stresses that as long as Libya does not fully integrate into the Barcelona process, any cooperation with Libya can only be limited in scope and take place on a technical ad hoc basis; calls upon the Commission to extend this cooperation to the main countries of origin and transit on the African continent in close relation with the relevant regional organisations to develop a wider approach to migration management on the African continent; calls upon the Member States and the Commission to implement swiftly the measures listed in the Annex, and calls upon the Member States to intensify, in particular in the framework of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union (the "Agency"), their cooperation on maritime external borders in the Mediterranean area and invites the Agency to include among its priorities in the working programme for 2005 and 2006 concrete operational actions on this issue; invites the Commission to provide regular reports on progress in cooperation with the main African countries of origin and transit and in the implementation of the measures to intensify cooperation within the EU.
