(6) The owner of the copyright in a work who, in respect of the work, has authorized a collective society to enter into a reprographic reproduction agreement with an educational institution is deemed to have authorized the society to enter into a digital reproduction agreement with the institution — subject to the same restrictions as a reprographic reproduction agreement — unless the owner has refused to give this authorization under subsection (5) or has authorized another collective society to enter into a digital reproduction agreement with respect to the work.

34. In taking any action pursuant to section 32, 33 or 37 in respect of a grade of wheat, the Governor in Council, following consultation with the board, or the Corporation may take that action in respect of any wheat within that grade that has an inherent quality characteristic that distinguishes it from any other wheat within that grade as if the wheat having that inherent quality characteristic were wheat of a different grade.

The agreement in the form of an Exchange of Letters between the European Union and the Argentine Republic pursuant to Article XXIV:6 and Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the amendment of concessions in the schedules of commitments of the Republic of Bulgaria and Romania in the context of their accession to the European Union (6) (hereinafter ‘the Agreement’), approved by Council Decision 2011/769/EU (7), provides, inter alia, for the addition of 122 790 tonnes of common wheat (of average and low quality), 890 tonnes of barley, 890 tonnes of malting barley and 35 914 tonnes of maize to the respective EU tariff quotas.

Notes that the Treaty of Lisbon introduces far-reaching changes in the decision-making system for the common fisheries policy (CFP) and will also increase its democratic accountability; welcomes the fact that Parliament and the Council will establish, under the ordinary legislative procedure, the necessary rules for achieving the objectives of the CFP (Article 43(2) of the TFEU); considers, in this respect, that any subject formally included in the annual regulation other than the setting of catch possibilities and the distribution of quotas, such as technical measures or fishing effort, or the incorporation of agreements adopted within the regional fisheries organisations, which have their own legal basis, should be subject to the ordinary legislative procedure;

Whereas Commission Regulation (EEC) No 1722/93 of 30 June 1993 laying down detailed rules for the application of Council Regulations (EEC) No 1766/92 and (EEC) No 1418/76 concerning production refunds in the cereals and rice sectors respectively (4), as last amended by Regulation (EC) No 3125/94 (5), must be adapted to take account of the import regime for cereals resulting from the Agreement on Agriculture concluded in the framework of the Uruguay Round of multilateral trade negotiations; whereas, in order to verify that the value of the production refund is correct, prices of maize and/or of wheat and of barley on the world and Community markets must be kept under observation;
