Article 8 of Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services, as amended by Directive 98/48/EC of the European Parliament and of the Council of 20 July 1998, read in conjunction with Article 10(1), final indent, of that directive, must be interpreted as not requiring notification of draft national legislation which obliges petroleum companies placing petrol and/or diesel fuels on the market also to place on the market, in the same calendar year, certain percentages of biofuels, where, after having been notified pursuant to the first subparagraph of Article 8(1), the draft was amended to take account of the Commission’s observations on it, and the amended draft was then communicated to the Commission.
L’article 8 de la directive 98/34/CE du Parlement européen et du Conseil, du 22 juin 1998, prévoyant une procédure d’information dans le domaine des normes et réglementations techniques et des règles relatives aux services de la société de l’information, telle que modifiée par la directive 98/48/CE du Parlement européen et du Conseil, du 20 juillet 1998, lu en combinaison avec l’article 10, paragraphe 1, dernier tiret, de ladite directive, doit être interprété en ce sens qu’il n’impose pas la notification d’un projet de réglementation nationale obligeant les sociétés pétrolières mettant sur le marché de l’essence et/ou des carburants diesel de mettre également sur le marché, au cours d’une même année civile, certains pourcentages de biocarburants, lorsque, après avoir été notifié en application dudit article 8, paragraphe 1, premier alinéa, ce projet a été modifié afin de tenir compte des observations de la Commission européenne relatives à ce dernier et que le projet ainsi modifié a ensuite été communiqué à celle-ci.

It is, however, of the utmost importance, for Parliament to be able to fully and timely exercise its prerogatives, that the Commission actively informs Parliament about all draft measures, amended draft measures and final draft measures, which it intends to adopt under Article 291 TFEU. Thus, as such draft measures, amended draft measures or final draft measures become available, the Commission should transmit them formally to the European Parliament.
Pour que le Parlement soit en mesure d'exercer pleinement et dans les délais ses prérogatives, il est toutefois essentiel que la Commission l'informe activement de tous les projets, projets modifiés et projets définitifs de mesures qu'elle entend adopter en vertu de l'article 291 du traité FUE. If the Authority has submitted an amended draft regulatory technical standard within the six-week period, the Commission may amend the draft regulatory technical standard on the basis of the Authority’s proposed amendments or adopt the regulatory technical standard with the amendments it considers relevant.

If the Authority has submitted an amended draft implementing technical standard within that six-week period, the Commission may amend the draft implementing technical standard on the basis of the Authority’s proposed amendments or adopt the implementing technical standard with the amendments it considers relevant.
