(77) In order to ensure a smooth transition between on the one hand the rules on the organic origin of plant reproductive material and on animals for breeding purposes provided for in Regulation (EC) No 834/2007 and the exception to production rules adopted pursuant to Article 22 of that Regulation, and on the other hand the new production rules for plants and plant products and livestock provided for in this Regulation, the power to adopt certain acts should be delegated to the Commission in respect of the granting of exceptions where exceptions are deemed necessary, in order to ensure access to plant reproductive material and live animals for breeding purposes that may be used in organic production.

(26) In order to ensure the efficient registration of legal acts concerning the European trade mark as object of property and ensure full transparency of the register of European trade marks, the power to adopt delegated acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of specifying certain obligations of the applicant regarding specific trade marks, the details on the procedures for entering the transfer of European trade marks, the creation and transfer of a right in rem, the levy of execution, the involvement in an insolvency procedure and the grant or transfer of a licence in the Register and for cancelling or modifying relevant entries.
(26) Pour garantir l'enregistrement optimal des actes juridiques relatifs à la marque européenne en tant qu'objet de propriété et la transparence totale du registre des marques européennes, il convient de déléguer à la Commission le pouvoir d’adopter, conformément à l'article 290 du traité, des actes délégués précisant certaines obligations que le demandeur doit respecter pour certaines marques, le détail des procédures à suivre pour l'inscription au registre du transfert de marques européennes, de la création et du transfert d’un droit réel, de l'exécution forcée, de l'inclusion dans une procédure d'insolvabilité et de l'octroi ou du transfert d'une licence, ainsi que pour la suppression ou la modification des inscriptions correspondantes.

Notes the wide-ranging reforms undertaken by the Georgian Government following the Rose Revolution; encourages further progress to be made in pluralistic governance and dialogue between the government and the opposition, the rule of law and compliance with human rights obligations, particularly as regards independence of the judiciary, zero-tolerance of police violence, criminal justice reforms and the improvement of detention conditions; calls on the Georgian authorities to respect property rights, freedom of assembly, freedom of expression, minority rights in compliance with the Framework Convention for the Protection of National Minorities, and freedom of the media; expects Georgia to fulfil ENP Action Plan objectives and Council of Europe recommendations with a view to the long-term sustainability of democratic governance, with particular regard to respect for pluralism and opposition, built-in mechanisms of checks and balances and institutional reform;

As rapporteur, I am therefore of the view that if the present draft decision were adopted, it would contravene Article 47 of the Treaty of the European Union. The latter requires the Union to respect the Community’s competence to act within the scope granted to it under the Treaty establishing the European Community, and prevents the Union from legislating within that scope.
Par conséquent, en tant que rapporteur, je pense que si la présente initiative de décision était adoptée, l’on contreviendrait à l’article 47 du traité sur l'Union européenne, qui oblige l’Union à respecter la capacité d’agir de la Communauté dans une matière déterminée, dont la compétence lui a été attribuée par le traité de la Communauté européenne et qui l’empêche de légiférer sur cette même matière.
