In addition, the right to access data entered in SIS II and the data concerning documents relating to persons entered in accordance with Article 38(2)(d) and (e) of Decision 2006/./JHA and the right to search such data directly may be exercised by the authorities responsible for issuing visas, the central authorities responsible for examining visa applications and the authorities responsible for issuing residence permits and for the administration of legislation relating to third-country nationals in the context of the application of the Community acquis relating to the movement of persons. Access to data by these authorities shall be governed by the law of each Member State.

(d) if the Community design is in conflict with a prior design which has been made available to the public after the date of filing of the application or, if a priority is claimed, the date of priority of the Community design, and which is protected from a date prior to the said date by a registered Community design or an application for such a design, or by a registered design right of a Member State, or by an application for such a right;

The application or non-application of such a right has a significant impact on the competitive environment within the internal market, since the existence or absence of an obligation to pay on the basis of the resale right is an element which must be taken into account by each individual wishing to sell a work of art. This right is therefore a factor which contributes to the creation of distortions of competition as well as displacement of sales within the Community.
L'application ou la non-application de celui-ci revêt un impact significatif sur les conditions de concurrence au sein du marché intérieur dans la mesure où l'existence ou non d'une obligation de paiement découlant du droit de suite est un élément qui est nécessairement pris en considération par toute personne désireuse de procéder à la vente d'une oeuvre d'art. The party who terminates the proceedings by withdrawing the Community trade mark application, the opposition, the application for revocation of rights, the application for a declaration of invalidity or the appeal, or by not renewing registration of the Community trade mark or by surrendering the Community trade mark, shall bear the fees and the costs incurred by the other party as stipulated in paragraphs 1 and 2.

La partie qui met fin à une procédure par le retrait de la demande de marque communautaire, de l'opposition, de la demande en déchéance ou en nullité, ou du recours, par le non-renouvellement de l'enregistrement de la marque communautaire ou par la renonciation à celle-ci, supporte les taxes ainsi que les frais exposés par l'autre partie dans les conditions prévues aux paragraphes 1 et 2.
