(2) Subject to subsections (3) and (4), where payment of a special allowance is approved in respect of a child, payment thereof shall commence with the month following the month in which the application therefor is received, but where a special allowance would have been payable before that month if an application therefor had been received, the special allowance is payable for each month commencing with the latest of

8 (1) The Minister may suspend payment of a special allowance where the Minister has reasonable grounds to believe, on the basis of information received, that an applicant’s continuing eligibility to receive the special allowance is in question and an investigation respecting that applicant’s eligibility for a special allowance has been commenced.

The amount of a special allowance payment made to a person or applicant to which the person or applicant is not entitled, or the amount in excess of the amount to which the person or applicant is entitled, may be deducted and retained, up to the full amount, from any payments of the special allowance thereafter payable to that person or applicant.

25. A department, agency or institution that is entitled to apply for a special allowance in respect of a child pursuant to the Family Allowances Act shall be deemed to be entitled to apply for the special allowance in respect of the child pursuant to the Children’s Special Allowances Act from and after the day on which the Children’s Special Allowances Act comes into force, and if the special allowance is payable with respect to a period during which the Family Allowances Act was in force, the amount of the special allowance with respect to that period shall, notwithstanding section 8 of the Children’s Special Allowances Act, be the amount that would have been payable under the Family Allowances Act.

(d) "applicant with special needs" means an applicant who due to age, gender, disability, mental health problems or consequences of torture, rape or other serious forms of psychological, physical or sexual violence is in need of special guarantees in order to benefit from the rights and comply with the obligations in accordance with this Directive.

In the case of applications for care allowances under Austrian federal law (Bundespflegegeldgesetz) submitted not later than 8 March 2001 on the basis of Article 10a(3) of this Regulation, this provision shall continue to apply as long as the beneficiary of the care allowance continues to reside in Austria after 8 March 2001.
