Under Article 3 of that Regulation concerning irregularities and the recovery of sums wrongly paid in connection with the financing of the Cohesion Fund and the organisation of an information system in this field, the beneficiary Member States are obliged to notify the Commission of irregularities which have been the subject of initial administrative or judicial investigations.

They include the option, when reserving seats, to name a contact person to be notified in the event of an accident; an obligation to notify families of the progress of an investigation before it is made public; confidentiality with regard to the names of people on board the aircraft, if their families so request; the appointment of a contact person to liaise with the victims’ families throughout the entire investigation; the obligation for Member States to have an accident emergency plan; the obligation for all airline companies established in Europe to have a crisis response plan, incorporating, among other things, psychological support for families; and, finally, a reminder of the obligation of all airlines operating in the EU to have minimum insurance cover to compensate victims’ families.

Although television broadcasters are normally bound to ensure that programmes present facts and events fairly, it is nevertheless important that they should be subject to specific obligations with respect to the right of reply or equivalent remedies so that any person whose legitimate interests have been damaged by an assertion made in the course of a broadcast television programme may effectively exercise such right or remedy.

This Regulation is without prejudice to any obligation on a Member State to notify individual grants of aid under other State aid instruments, and in particular the obligation to notify, or to inform the Commission of, aid to an enterprise receiving restructuring aid within the meaning of the Community guidelines on State aid for rescuing and restructuring firms in difficulty(10) and the obligation to notify regional aid for large investment projects under the applicable multisectoral Framework".
