(2) Council Directive 91/440/EEC of 29 July 1991 on the development of the Community's railways(5) provides for certain access rights in international rail transport for railway undertakings, and international groupings of railway undertakings; these rights mean that railway infrastructure can be used by multiple users.

It is recalled that on 2 April 1998, the Commission submitted to the Council a Communication that takes stock of the transposition of the obligations imposed by the above mentioned Directive in each Member State, such as management independence of railway undertakings, separation of infrastructure management and transport operations, reduction of debt and improvement of finances as well as establishment of access rights to railway infrastructure, limited to international groupings of railway undertakings and undertakings providing international combined transport services.
