(5) In order to facilitate the application of Regulation (EEC) No 1408/71, there should be certain provisions concerning on the one hand civil servants and persons treated as such and, on the other, members of the travelling or flying personnel of an undertaking which operates international transport services for passengers or goods by rail, road, air or inland waterway, and also to specify the methods for determining the average amount to take into account in the context of Article 23 of the Regulation.

4. A person who is employed as a civil servant or personnel treated as such and insured in a special scheme for civil servants in one Member State and who simultaneously pursues an activity as an employed person and/or as a self-employed person in the territory of one or more other Member States shall be subject to the legislation of the Member State in which he is insured as a civil servant or personnel treated as such.

Consequently, national bodies to which applications for social security benefits under a special scheme for civil servants or persons treated as such have been made directly under Articles 48 and 51 of the Treaty, before measures to coordinate such schemes have been adopted at Community level, cannot be required to apply by analogy the provisions of Regulation No 1408/71 laid down for the social security schemes coming within its material scope.

With specific regard to the special schemes for civil servants or persons treated as such, the Community legislature discharged that obligation only when it adopted Regulation No 1606/98, which entered into force on 25 October 1998, thereby leaving, for the preceding period, a substantial void in the Community coordination of social security schemes.

The Commissioner concluded on this point by saying that while considerable progress has been made there are a number of areas in which further initiatives might be taken with a view to ensuring a genuine and effective opening up of national public services. In particular : - the adoption of the regulation now pending before the Council on the "extension" of Regulation 1408/71 to special schemes for civil servants and persons treated as such; - comparative law studies should be launched into the major issues of principle, which could have serious consequences on the actual exercise of the right to freedom of movement in the public sector and which are not at present directly regulated by existing Community legislation; - an inventory needs to be drawn up of all the barriers (both overt and covert) which still stand in the way of exercise of the right to freedom of movement in the public sector in the different Member States; - preparation (and regular updates) of explanatory handbooks on the Community law applicable for the use of both individuals and the responsible national public services; - continuation and development of the exchanges of officials responsible for freedom of movement under the Karolus programme.
Le Commissaire a conclu en déclarant que, si des progrès considérables ont déjà été accomplis, de nouvelles initiatives pourraient être prises dans un certain nombre de domaines afin d'assurer l'ouverture réelle et effective de services publics nationaux, à savoir en particulier : - adoption du règlement pendant au Conseil concernant l'"extension" du règlement 1408/71 aux régimes spéciaux applicables aux fonctionnaires et personnes assimilées; - études de droit comparé destinées à approfondir les grandes questions de principe susceptibles d'avoir de sérieuses conséquences sur l'exercice du droit à la libre circulation dans le secteur public et non encore directement réglées par la législation communautaire existante; - inventaire de toutes les entraves (manifestes et voilées) qui font encore obstacle, dans les différents États membres, à l'exercice du droit à la libre circulation dans le secteur public; - rédaction (et mise à jour régulière) de manuels explicatifs du droit communautaire applicable, à l'usage tant des citoyens individuels que des responsables des administrations publiques nationales; - poursuite et développement des échanges de fonctionnaires en charge de la libre circulation, dans le cadre du programme Karolus.
