For the purposes of protecting the Community financial interest and securing the overriding interest in the conservation of fisheries resources, the financial assistance in the framework of Council Regulation (EC) No 1198/2006 of 27 July 2006 on the European Fisheries Fund and Council Regulation (EC) No 861/2006 of 22 May 2006 establishing Community financial measures for the implementation of the common fisheries policy and in the area of the Law of Sea should be made conditional upon compliance by Member States with their obligations in the fields of fisheries control and thus suspension and cancellation of such financial assistance should be foreseen in cases of an inadequate implementation of the rules of common fisheries policy by Member States which affects the effectiveness of the measures being financed.
Dans le but de protéger les intérêts financiers de la Communauté et de préserver l’importance majeure de la conservation des ressources de pêche, l’aide financière prévue dans le cadre du règlement (CE) no 1198/2006 du Conseil du 27 juillet 2006 relatif au Fonds européen pour la pêche ( et du règlement (CE) no 861/2006 du Conseil du 22 mai 2006 portant mesures financières communautaires relatives à la mise en œuvre de la politique commune de la pêche et au droit de la mer devrait être subordonnée au respect, par les États membres, de leurs obligations en matière de contrôle de la pêche et il convient, dès lors, de prévoir la suspension ou l’annulation de cette aide financière en cas de mise en œuvre insatisfaisante des règles de la politique commune de la pêche par les États membres compromettant l’efficacité des mesures faisant l’objet du financement.

(10) The vessels due to operate in international waters or in waters of third countries must fully respect international law with regard to the conservation of fishing resources and in particular the United Nations Convention on the Law of Seas as well as the Code of Conduct of the Food and Agriculture Organisation of the United Nations.
(10) Il y a lieu que les navires devant opérer dans les eaux internationales ou dans les eaux de pays tiers respectent intégralement le droit international en matière de conservation des ressources halieutiques, et notamment la convention des Nations unies sur le droit de la mer ainsi que le code de conduite de l'Organisation des Nations unies pour l'alimentation et l'agriculture.

2. Nothing in this Protocol shall prejudice the codification and development of the law of the sea by the United Nations Conference on the Law of the Sea convened pursuant to resolution 2750 C (XXV) of the General Assembly of the United Nations, nor the present or future claims and legal views of any State concerning the law of the sea and the nature and extent of coastal and flag State jurisdiction.
2. Aucune disposition du présent protocole ne peut porter atteinte à la codification et à l'élaboration du droit de la mer par la Conférence des Nations unies sur le droit de la mer convoquée en vertu de la résolution 2750 C (XXV) de l'Assemblée générale des Nations unies, ni aux revendications ou positions juridiques présentes ou futures de tout État touchant le droit de la mer et la nature et l'étendue de la juridiction de l'État riverain et de l'État du pavillon.
