6 (1) Subject to this section and section 8, section 3 does not apply in respect of goods for use as designated goods that are brought within the limits of the continental shelf of Canada after June 30, 1983 pursuant to a written contract entered into prior to January 6, 1983, when the goods are used or consumed within the limits of the continental shelf of Canada.

The Commission shall be empowered to adopt delegated acts in accordance with Article 30a, allowing such derogations on condition that they are justified by specific geographical features of the sea areas concerned, such as the limited size of continental shelf along the entire coastline of a Member State or the limited extent of trawlable fishing grounds, where the fisheries have no significant impact on the marine environment and affect a determined group of vessels of the Member State or, as the case may be, of other Member States, and provided that those fisheries cannot be undertaken with another gear and are subject to a management plan as referred to in Articles 18 or 19.

On 27 October 2011, the Commission published a proposal for a Council Decision to approve the accession of the European Union to the Protocol for the Protection of the Mediterranean Sea against pollution resulting from exploration and exploitation of the continental shelf and the seabed and its subsoil (the “Offshore Protocol”).

A lot of this will be resolved by the United Nations Commission on the Limits of the Continental Shelf by looking at the science to determine whether the seabed is a natural prolongation of one country's continental shelf as opposed to another country's continental shelf.

23. Urges the Commission, in view of the particular circumstances of the exclusive economic zones of the outermost regions (absence of a continental shelf in certain cases) and the limitations of their fisheries zones (often confined to submarine hills), to apply, without hesitation, the precautionary principle and the principle of relative stability, thereby helping ensure not only biological and ecological balance for the species concerned, but also the protection of the socio-economic fabric related to the fisheries sector in those regions; urges the Commission also to take account in its legislative proposals of the fact that fishing activity in some of the outermost regions, for example in the Indian Ocean, is very recent and that fish stocks in these areas are still rich;

Believes the Commission should, in view of the particular circumstances of the EEZs of the outermost regions (absence of a continental shelf in certain cases) and the limitations of their fisheries zones (often confined to submarine hills), apply, without hesitation, the precautionary principle and the principle of relative stability; this would help ensure not only biological and ecological balance for the species concerned, but also the protection of the socio-economic fabric related to the fisheries sector in those regions; the Commission should also take account in its legislative proposals of the fact that fishing activity in some of the outermost regions, for example in the Indian Ocean, is very recent and that fish stocks in these areas are still rich;
