IN-CONTEXT TRANSLATIONS

In the light of this proposal and as our Parliamentary group has stressed, it is worrying that the report establishes that ‘notwithstanding the necessity of providing the sentenced person with adequate safeguards, his or her involvement in the proceedings should no longer be dominant by requiring in all cases his or her consent to the forwarding of a judgment to another Member State for the purpose of its recognition and enforcement of the sentence imposed’, particularly since we fail to see how not ensuring this principle is consistent with the aim of the Framework Decision: to help to rehabilitate the person sentenced.
Au vu de cette proposition et comme notre groupe parlementaire l'a souligné, il est inquiétant que le rapport établisse que nonobstant la nécessité d’apporter à la personne condamnée des garanties adéquates, son implication dans les procédures ne devrait plus être dominante en demandant son consentement dans toutes les affaires pour transmettre un jugement à un autre État membre dans le but de reconnaitre et d'appliquer la condamnation imposée, plus particulièrement vu que nous ne trouvons pas comment le fait de ne pas garantir ce principe correspond à l'objectif de la décision cadre: aider à réhabiliter les personnes condamnées.

Finally, several miscellaneous terms were used throughout the Report and these have also been defined including advance directives, surrogate decision-maker, substituted judgment, best interests judgment, futile treatment, and free and informed consent.
