Definition: Should be diagnosed when fear of separation constitutes the focus of the anxiety and when such anxiety first arose during the early years of childhood. It is differentiated from normal separation anxiety when it is of a degree (severity) that is statistically unusual (including an abnormal persistence beyond the usual age period), and when it is associated with significant problems in social functioning.

Thus, the category should be used when there are dysfunctions meeting the criteria for two or more of F80.-, F81.- and F82.

to fully implement the judgments of the Constitutional Tribunal of 3 and 9 December 2015 which requires that the three judges lawfully nominated in October 2015 can take up their function; to publish and fully implement all the judgments of the Constitutional Tribunal, including those of 9 March and 11 August 2016 concerning the Law on the Constitutional Tribunal; to ensure that any reform of the Law on the Constitutional Tribunal respects the judgments of the Constitutional Tribunal, takes the Opinion of the Venice Commission fully into account and ensures that the effectiveness of the Constitutional Tribunal as a guarantor of the Constitution is not undermined; to refrain from actions and public statements which could undermine the legitimacy and efficiency of the Constitutional Tribunal.

In contrast, Croatia and Serbia must first haul their war criminals before the International Criminal Tribunal for the Former Yugoslavia in The Hague before the Copenhagen criteria can even come into play. While the unlawful regulations of the Anti-Fascist Council of the People’s Liberation of Yugoslavia (AVNOJ) and Beneš do not constitute grounds for blocking EU accession, the Serbian restitution policy certainly has to comply with EU stipulations.

From this point of view, I feel a sense of frustration, not so much because a judgment of the Constitutional Court of Belgrade – the legitimacy of which is doubtful – was breached, but rather because the dignity of the democratic forces in Serbia and Yugoslavia was violated. These forces have been forced to split in the face of financial pressure from a great power which, moreover, itself rejects the principle of an International Criminal Tribunal.
Il est vrai que les conditions dans lesquelles vient d'avoir lieu son transfèrement devant le TPI entache l'avancée historique que pouvait représenter une telle mesure. Je ressens, de ce point de vue, une frustration, non pas tant du fait de la violation d'une décision de la Cour constitutionnelle de Belgrade - dont la légitimité est douteuse - mais bien plutôt du fait de la violation de la dignité des forces démocratiques serbes et yougoslaves conduites à se diviser gravement, face aux pressions financières d'une grande puissance qui, au demeurant refuse, quant à elle, le principe d'une Cour pénale internationale.
