Welcomes the completion of the Common European Asylum System (CEAS) and calls on the Member States to make the necessary legislative and administrative reforms to effectively implement it so as to ensure that the CEAS is fully established as planned, provides better access to the asylum procedure for those who seek protection, leads to fairer, quicker and better-quality asylum decisions and provides dignified and decent conditions both for those who apply for asylum and those who are granted international protection within the EU; deplores, however, the fact that children can still be placed in detention and calls for them to be systematically excluded from accelerated procedures; reiterates its call for the Commission to draw up strategic guidelines based on best practices to establish common minimum standards for the reception and protection of unaccompanied children; underlines the fact that procedural safeguards must be adequate and appropriate; calls for the application of the recent ECJ judgment stating that LGBT applicants for asylum can constitute a particular social group who are liable to be persecuted on account of their sexual orientation and that the existence of a term of imprisonment in the country of origin sanctioning homosexual acts may constitute an act of persecution per se;
40. se félicite de la mise en place du régime d'asile européen commun (RAEC) et demande aux États membres d'engager les réformes législatives et administratives nécessaires à sa bonne mise en œuvre, de façon à ce que ce régime fonctionne comme prévu, à savoir qu'il permette un meilleur accès aux procédures d'asile pour les personnes qui demandent une protection, qu'il permette la prise de décisions plus équitables, plus rapides et mieux fondées en la matière et qu'il instaure des conditions de vie dignes et décentes tant pour les demandeurs d'asile que pour ceux qui reçoivent une protection internationale au sein de l'Union; regrette cependant que des enfants puissent encore être placés en détention, et demande leur exclusion systématique des procédures accélérées; renouvelle sa demande à la Commission pour qu'elle élabore des orientations stratégiques sur la base des bonnes pratiques, afin de mettre en place des normes minimales communes pour l'accueil et la protection des mineurs non accompagnés; souligne que les garanties procédurales doivent être adéquates et appropriées; demande la mise en œuvre de l'arrêt récent de la CJUE indiquant que les demandeurs d'asile LGBT peuvent constituer un groupe social spécifique et sont susceptibles d'être persécutés en raison de leur orientation sexuelle, et que l'existence, dans leur pays d'origine, d'une peine d'emprisonnement qui pénalise des actes homosexuels est susceptible, à elle seule, de constituer un acte de persécution;

K. whereas the Constitution calls for the adoption of over 50 of so-called cardinal laws, also subject to constitutional majority of 2/3, which will stipulate a great range of issues concerning the institutional system of Hungary, the application of fundamental rights, as well as cultural, religious, socio-economic and financial policies, which practically makes their adoption a part of the constitutional process and hence risk to render void the powers and competences of future parliaments and governments in these policy fields, and whereas the Constitution provides its Preamble with legal significance, which may have legal and political implications and may lead to legal uncertainty,

The Commission will re-examine the feasibility and necessity of a framework law on services of general interest when the Constitutional Treaty comes into force, in particular the new legal basis introduced by Article III-122 which states that: "Without prejudice to Articles III-55, III-56 and III-136, and given the place occupied by services of general economic interest as services to which all in the Union attribute value as well as their role in promoting social and territorial cohesion, the Union and the Member States, each within their respective powers and within the scope of application of the Constitution, shall take care that such services operate on the basis of principles and conditions, in particular economic and financial, which enable them to fulfil their missions.

Once the Constitutional Treaty has entered into force, this provision will provide an additional legal basis for Community action in the field of services of general economic interest, within the powers of the Union and within the scope of application of the Constitution.
