(2) If a court sentencing a person, vessel or oil handling facility under subsection (1) for contravening a provision of the regulations made under paragraph 35(1)(d) or (3)(a) is of the opinion that the provision that the person, vessel or facility contravened is equivalent to a provision of the regulations made under another provision of this Act and if the punishment provided under this Act for contravening that provision of the regulations is less than the punishment provided under subsection (1), the person, vessel or oil handling facility is liable to that lesser punishment.

(10) Notwithstanding section 51, every person who contravenes a regulation made under subsection (1) or (5) by contravening a provision of an Act of the legislature of a province that, or an instrument made under such Act that, is incorporated by the regulation is guilty of an offence against this Act and is liable to the same punishment as is imposed by or under any Act of that legislature for the contravention of that provision.
(10) Par dérogation à l’article 51, quiconque enfreint un règlement pris en vertu des paragraphes (1) ou (5) en violant une disposition du texte incorporé commet une infraction à la présente loi et encourt, le cas échéant, la peine prévue par les lois de la province en cas d’infraction à la disposition.

27.2 (1) No employer shall dismiss, suspend, demote, discipline, harass or otherwise disadvantage an employee, or deny an employee a benefit of employment, by reason that (a) the employee, acting in good faith and on the basis of reasonable belief, has disclosed to the Commissioner that the employer or any other person has contravened or intends to contravene a provision of Division 1; (b) the employee, acting in good faith and on the basis of reasonable belief, has refused or stated an intention of refusing to do anything that is a contravention of a provision of Division 1; (c) the employee, acting in good faith and on the basis of reasonable belief, has done or stated an intention of doing anything that is required to be done in order that a provision of Division 1 not be contravened; or (d) the employer believes that the employee will do anything referred to in paragraph (a), (b) or (c) (2) Nothing in this section impairs any right of an employee either at law or under an employment contract or collective agreement (3) In this section, " employee" includes an independent contractor and " employer" has a corresponding meaning" .

4. Any agreement that contravenes the provision of paragraph 3 shall be void.
