(2) Every reference to the Canada Customs and Revenue Agency, the Commissioner of Customs and Revenue, the Deputy Commissioner of Customs and Revenue or any person under their authority in a document issued in the name of the Canada Customs and Revenue Agency, the Commissioner of Customs and Revenue or the Deputy Commissioner of Customs and Revenue is to be read in respect of those documents that relate to those portions of the Canada Customs and Revenue Agency the control and supervision of which were transferred to the former agency by order P.C. 2003-2064, unless the context otherwise requires, as a reference to the new agency, the President of the new agency, the Executive Vice-president of the new agency or a person under their authority, as the case may be.

(2.1) Despite subsections (1) and (2), a notice, demand, order or other document issued with respect to a customer of a bank constitutes notice to the bank and fixes the bank with knowledge of its contents and, where applicable, is binding on property belonging to the customer and in the possession of the bank or on money owing to the customer by reason of an account in the bank, if it is sent to the branch of the bank referred to in subsection (1) or (2), an office of the bank referred to in paragraph (3)(a) or any other office agreed to by the bank and the Minister of National Revenue and it relates to

Supports the Commission's efforts to facilitate communication between traders and Member States; proposes, however, further improvements: in particular urges the Commission to publish all the relevant information and documentation on the meetings with national experts as soon as they are available in order to provide direct access to overviews, for trade representatives and any citizens concerned by developments in the area of customs, of the discussions carried out at those meetings; is convinced that this would, in particular, benefit SMEs, ensure transparency and raise public awareness of customs-related issues;

1. The Commission may, following a request to a Member State as referred to in paragraph 1a and in accordance with Article 14 of Regulation 2913/92, obtain directly from economic operators documents supporting import and transit declarations and for which supporting documents have been generated or collected by the economic operators , with respect to investigations related to the implementation of customs legislation as defined in Article 2(1) with either the explicit authorisation of a Member State or with the tacit authorisation specified in 18h(1b).
1. La Commission peut, à la suite d'une demande à un État membre, visée au paragraphe 1 bis, conformément à l'article 14 du règlement (CEE) n o 2913/92, obtenir directement auprès des opérateurs économiques les documents accompagnant les déclarations d'importation ou de transit, pour lesquels les documents justificatifs ont été créés ou collectés par les opérateurs économiques, aux fins des enquêtes liées à la mise en œuvre de la réglementation douanière définie à l'article 2, paragraphe 1, avec soit l'autorisation explicite d'un État membre, soit l'autorisation tacite spécifiée à l'article 18 nonies, paragraphe 1 ter .

"(14) 'Customs controls' mean specific acts performed by the customs authorities or co-ordinated with them, in order to ensure the correct application of customs legislation and other legislation relating to the import or export of goods, such as examining goods, verifying the existence and authenticity of documents, examining the accounts of undertakings and other records, inspecting means of transport, inspecting luggage and other goods carried by or on persons and carrying out official inquiries and other similar acts with a view to ensuring that customs rules and, where appropriate, other provisions applicable to goods subject to customs supervision are observed.

(14) In order to ensure the correct application of this Regulation, it is necessary to provide with a rapid and efficient exchange of information about means of identification and related documents between Member States. Community provisions relating thereto have been established by Council Regulation (EC) No 515/97 of 13 March 1997 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters and by Council Directive 89/608/EEC of 21 November 1989 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of legislation on veterinary and zootechnical matters.
(14) Afin de garantir l'application correcte du présent règlement, il est nécessaire de prévoir un échange rapide et efficace d'informations entre les États membres sur les moyens d'identification et les documents correspondants. es dispositions communautaires y afférentes ont été arrêtées par le règlement (CE) n° 515/97 du Conseil du 13 mars 1997 relatif à l'assistance mutuelle entre les autorités administratives des États membres et à la collaboration entre celles-ci et la Commission en vue d'assurer la bonne application des réglementations douanière et agricole et par la directive 89/608/CEE du Conseil du 21 novembre 1989 relative à l'assistance mutuelle entre les autorités administratives des États membres et à la collaboration entre celles-ci et la Commission en vue d'assurer la bonne application des législations vétérinaire et zootechnique.
