40 (1) Where merchantable scrap, waste or by-products result from the destruction or disposal of goods or the incorporation of goods into other goods in respect of which a refund of duties is to be granted under the Act, the amount of the refund shall be reduced by an amount determined by applying to the value of the merchantable scrap, waste or by-products produced the rate of duty under the Customs Tariff that applies on the date of production to the merchantable scrap, waste or by-products.

2. Where the declarant or holder of the goods has not confirmed his or her agreement to destruction within the period referred to in paragraph 5, nor notified his or her opposition to destruction to the customs office that adopted the decision to suspend the release of the goods or to detain them, the customs authorities may deem that the declarant or holder of the goods has agreed to their destruction.

The legislative content of the Code can be subdivided into three parts: a) an introductory section which contains the basic rules and concepts of customs law (focusing on the Community's customs territory, the Customs Tariff of the European Communities, value for customs purposes and the origin of goods) and describes the provisions applicable to goods brought into the customs territory of the Community (formalities, freedom of movement etc.); b) a central section describing the various types of customs-approved treatment or use applicable to goods: customs procedures with economic impact (free zones, temporary admission, processing under customs control etc.); reexportation of goods; destruction etc.; c) the last section focuses on the provisions governing customs debt and the rules applicable to the right of appeal in customs matters.
