In this fundamental sector of air traffic safety, another important element is the establishment of the European Aviation Safety Agency, whose mission is to promote the highest possible level of safety and environmental protection by civil aviation. The Community institutions have also addressed cases of aircraft operated within the Community by third country carriers, i.e. carriers outside the Community, and Community rules have been laid down for granting crew licences, for operations and for safety standards.
Dans ce domaine, essentiel, de la sécurité du transport aérien un autre élément important est la mise en place de l’Agence européenne de la sécurité aérienne. Sa mission est de promouvoir le plus haut niveau possible de sécurité et de protection environnementale de l’aviation civile et les institutions communautaires se sont également attachées aux cas des avions qui étaient exploités à l’intérieur de la Communauté par des transporteurs tiers, c’est-à-dire, en dehors de la Communauté, et des règles communautaires ont été fixées en ce qui concerne l’octroi de licences aux équipages, l’exploitation et les normes de sécurité.

(2) Customs administrations play a vital role in protecting the interests of the Community, particularly its financial interests. They also provide an equivalent level of protection to the citizens and economic operators of the Community at any point in the Community customs territory where customs clearance formalities are carried out.

‘operating ban’ means the refusal, suspension, revocation or restriction of an air carrier’s operating authorisation or technical permission for safety reasons, or any equivalent safety measures in respect of an air carrier which has no traffic rights in the Community but whose aircraft might otherwise be operated in the Community under a lease agreement.

Provision should be made for an operating ban included in the Community list to apply equally to such air carriers, since these air carriers could otherwise operate in the Community while not complying with the relevant safety standards.
Il convient de prévoir qu’une interdiction d’exploitation figurant sur la liste communautaire s’applique de même à ces transporteurs aériens, faute de quoi ces derniers pourraient opérer dans la Communauté tout en ne respectant pas les normes de sécurité applicables.
