B. whereas the EU has developed an extensive toolbox of instruments as a policy framework to support this obligation, including human rights guidelines, a global financial instrument on human rights and democracy (the European Instrument for Democracy and Human Rights (EIDHR)), a requirement for all external financial instruments – such as the Development Cooperation Instrument (DCI), the Instrument for Stability (IfS), the European Neighbourhood Instrument (ENI), the Pre-Accession Instrument (IPA) and the Partnership Instrument (PI) – to promote human rights and democracy within their remit, the establishment of the EED, the appointment of the new EU Special Representative for Human Rights, Council declarations and conclusions, statements by the High Representative, EU démarches, EU sanctions in the event of severe human rights violations and, more recently, human rights country strategies;
B. considérant que l'Union a élaboré une panoplie d'instruments servant de cadre d'action pour faire face à cette obligation, notamment des lignes directrices en matière de droits de l'homme, un instrument financier mondial en matière de droits de l'homme et de démocratie (l'instrument européen pour la démocratie et les droits de l'homme (IEDDH)), une exigence pour les instruments financiers externes – tels que l'instrument de financement de la coopération au développement, l'instrument de stabilité, l'instrument européen de voisinage, l'instrument de pré-adhésion et l'instrument de partenariat – afin de promouvoir les droits de l'homme et la démocratie dans la limite de leurs compétences, la création du FEDEM et la désignation du nouveau représentant spécial de l'Union pour les droits de l'homme, des déclarations et des conclusions du Conseil, des déclarations de la haute représentante, des démarches au niveau de l'Union, des sanctions imposées par l'Union en cas de graves violations des droits de l'homme et, plus récemment, la mise en place de stratégies par pays en matière de droits de l'homme;

In order to establish the ‘EC’ declaration of verification, the applicant shall invite the notified body that it has selected for that purpose to apply the ‘EC’ verification procedure referred to in Annex VI. The applicant may be the contracting entity or the manufacturer, or their authorised representative within the Community.

6.6. Where the subsystem meets the requirements of Directive 96/48/EC and the TSI, the notified body must then, based on the type-examination and the approval and surveillance of the quality system(s), draw up the certificate of EC verification intended for the adjudicating entity or its authorised representative established within the Community, which in turn draws up the EC declaration of verification intended for the supervisory authority in the Member State within which the subsystem is located and/or operates.
6.6. if the Commission has indicated to the national regulatory authority that it has serious doubts as to the compatibility of the draft measure made available according to paragraph 2 with Community law and in particular the objectives referred to in Article 7, then the measure shall not be adopted for a further one month. Within that period the Commission may, where appropriate, make public a detailed opinion which it shall communicate to the national regulatory authority concerned stating why it considers that the draft measure is not compatible with Community law, and in particular the objectives referred to in Article 7.
