TRADUCTIONS EN CONTEXTE

ESA programmes are governed by the industrial policy principles established in the ESA Convention, in particular by exploiting competitive bidding while distributing industrial contracts in proportion to funding from Member States (“fair return”).

ESA should then be positioned within the EU framework and its Convention modified accordingly.

RECOGNISES that the uses made by any military users of Galileo or GMES must be consistent with the principle that Galileo and GMES are civil systems under civil control, and consequently that any change to this principle would require examination in the framework of the Title V/TEU and in particular Articles 17 and 23 thereof, as well as in the framework of the ESA Convention;

(b) the participation by the European Community in an optional programme of the European Space Agency, in accordance with Article V. I.b of the ESA Convention;

Under no circumstances shall the European Community be bound to apply the rule of «geographical distribution» contained in the ESA Convention and specially in Annex V thereto. Compliance with the rules relating to financial control and auditing of the Party contributing to the joint initiatives, or of both Parties in case of joint contribution, shall apply to any joint activity.
En aucun cas, la Communauté européenne n'est tenue d'appliquer la règle dite de «répartition géographique» prévue par la convention de l'ASE et plus précisément son annexe V. Furthermore it has to be seen whether the draft Statute is legally compatible with Belgian law and with the ESA Convention.

I. whereas the European Armaments, Research and Military Capabilities Agency provided for in the Convention's Article III-212 will serve to implement structured cooperation among the Member States in the defence technology sector, thereby helping to create an environment conducive to a more competitive European industry, especially in the space sector, working in collaboration with the ESA where research, technological development and boosting industrial supply, and independence as regards strategic technologies are concerned,
I. considérant que l'Agence européenne de l'armement, de la recherche et des capacités militaires, prévue à l'article III-212 de la Convention, pourra mettre en œuvre la coopération structurée entre les États membres dans le domaine de la technologie de défense, contribuant ainsi à la création d'un climat favorable à une industrie européenne plus concurrentielle, notamment dans le domaine spatial, en collaboration avec l'ESA pour ce qui concerne la recherche, le développement technologique et l'augmentation de l'offre industrielle, ainsi que l'indépendance de l'Europe dans les technologies stratégiques,

17. Considers that the Convention's approach regarding a European Armaments, Research and Military Capabilities Agency, which would be open to all Member States in accordance with the structured cooperation method, could help to bring about the industrial and technological organisation of space in cooperation with the ESA and in accordance with the principle of non-duplication of responsibilities and organisational structures; emphasises the dual nature of space activities and the need to take advantage of synergies between civil and military activities so as to reduce research costs and improve the competitiveness of commercial launches; favours development of the activities of the new agency while bearing in mind the United Nations General Assembly resolution on prevention of an arms race in outer space;
17. est d'avis que l'idée, formulée dans la Convention, d'instaurer une Agence européenne de l'armement, de la recherche et des capacités militaires qui soit ouverte à tous les États membres selon la méthode de la coopération structurée pourrait contribuer à une véritable exploitation industrielle et technologique de l'espace, en collaboration avec l'ESA, selon le critère de la non-duplication des compétences et des organisations; souligne le caractère dual des activités spatiales et la nécessité de tirer parti des synergies entre les activités spatiales civiles et militaires afin de réduire les coûts de recherche et d'améliorer la compétitivité des lancements commerciaux; encourage le développement des activités de la nouvelle agence, conformément à la résolution de l'Assemblée générale des Nations unies sur la prévention d'une course aux armements dans l'espace;
