Participation in elections in the Member State of residence admittedly depends on various factors and should be seen in the light of the overall reduction in election turnout. Nevertheless the divergences between the rate of registration on the different Member States' electoral rolls are too wide to be attributed solely to factors that cannot be influenced by information campaigns.

2. This Regulation also applies to public documents the presentation of which may be required of citizens of the Union residing in a Member State of which they are not nationals when those citizens wish to vote or stand as candidates in elections to the European Parliament or in municipal elections in their Member State of residence, under the conditions laid down in Directive 93/109/EC and Council Directive 94/80/EC respectively.

Recalls that the Copenhagen European Council stated that "membership requires that the candidate country has achieved stability of institutions guaranteeing democracy, the rule of law, human rights, and the respect of and protection of minorities", thereby implying that no transition periods could be granted regarding these criteria.

Previously, an EU citizen wishing to stand for election in another Member State of which s/he was not a national had to provide certification from their Member State of citizenship that they were not disqualified from standing in European Parliamentary elections in that state, As of the 2014 elections, when an EU citizen submits his/her application to stand for election, s/he shall provide a declaration instead of the certification.
