(59) This Regulation respects the fundamental rights and observes the principles recognized in particular by the Charter of Fundamental Rights of the European Union and notably human dignity, the integrity of the person, the principle of free and informed consent of the person concerned, the protection of personal data, the freedom of art and science, the freedom to conduct business and the right to property, as well as the European Convention on Human Rights and Biomedicine as well as the Additional Protocol to that Convention concerning Genetic Testing for Health Purposes.

This Directive is based on international experience drawn upon through an extensive consultation, the Council of Europe’s Guide to safety and quality assurance for organs, tissues and cells, the European Convention on Human Rights, the Council of Europe’s Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine (Oviedo, 4.IV.1997), with its additional protocols, and recommendations from the World Health Organisation.

(22) This Directive respects the fundamental rights and observes the principles reflected in the Charter of Fundamental Rights of the European Union(9) and takes into account as appropriate the Convention for the protection of human rights and dignity of the human being with regard to the application of biology and medicine: Convention on human rights and biomedicine.

62. Recalls that, according to the European Convention on Human Rights and Biomedicine and the additional protocol, every individual has a right to his genetic identity and that human cloning is and must remain prohibited; reiterates its call for a European Union ethics committee to be set up to guarantee respect for human dignity with regard to genetic engineering applications;

These include, inter alia, principles reflected in the Charter of fundamental rights of the European Union, protection of human dignity and human life, protection of personal data and privacy as well as the environment in accordance with Community law and, where relevant, international conventions, such as the Declaration of Helsinki, the Council of Europe Convention on Human Rights and Biomedicine signed in Oviedo on 4 April 1997 and the Additional Protocol on the Prohibition of Cloning Human Beings signed in Paris on 12 January 1998, the UN Convention on the Rights of the Child, the Universal Declaration on the Human Genome and Human Rights adopted by UNESCO, and the relevant World Health Organisation (WHO) resolutions, the Amsterdam Protocol on Animal Protection and Welfare; and current legislation, regulations and ethical guidelines in countries where the research will be carried out.
