(1) La mise en place d'un système européen de surveillance des frontières (ci-après dénommé 'EUROSUR') est nécessaire en vue de renforcer l'échange d'informations et la coopération opérationnelle entre les autorités nationales des États membres et avec l'Agence européenne pour la gestion de la coopération opérationnelle aux frontières extérieures des États membres de l'Union européenne, créée par le règlement (CE) nº 2007/2004.du Conseil , ci-après dénommée l'"Agence".

(1) The establishment of a European Border Surveillance System (hereinafter referred to as 'EUROSUR') is necessary in order to strengthen the information exchange and operational cooperation between national authorities of Member States as well as with the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union established by Council Regulation (EC) No 2007/2004 of 26 October 2004 (Frontex), hereinafter referred to as ‘the Agency’.
(1) La mise en place d'un système européen de surveillance des frontières (ci-après dénommé "Eurosur") est nécessaire en vue de renforcer l'échange d'informations et la coopération opérationnelle entre les autorités nationales des États membres et avec l'Agence européenne pour la gestion de la coopération opérationnelle aux frontières extérieures des États membres de l'Union européenne créée par le règlement (CE) n° 2007/2004 du Conseil du 26 octobre 2004 (Frontex), ci-après dénommée l'"Agence".

20. For the sake of the legal security of all the actors involved, it is proposed that any mechanism aiming at the cross-border exchange of data from various existing databases is made subject to a clear legal framework on a need-to-know basis, defining at least the nature of the data involved, the capability of the data providers, the purposes (and the methods) of the exchange and the potential recipients of the data, as well as incorporating the necessary safeguards with regard to the confidentiality and security of (certain) data and the protection of personal data, where this may be relevant and taking into account existing legal provisions and operational systems at EU level.
1) Afin de garantir la sécurité juridique de l'ensemble des parties concernées, il est proposé que tout mécanisme destiné à permettre l'échange transfrontalier de données issues de différentes bases de données soit soumis à un cadre juridique précis selon le principe du «besoin d'en connaître» qui, selon le cas et compte tenu des dispositions juridiques et des systèmes opérationnels existant au niveau communautaire, définisse à tout le moins la nature des données considérées, les compétences des fournisseurs de données, les finalités de l'échange (et les méthodes mises en œuvre pour y parvenir) et les destinataires potentiels de ces données, et qui prévoie les garanties nécessaires en matière de confidentialité et de sécurité de (certaines) données et la protection des données à caractère personnel.

The air navigation service provider shall ensure that the implementation of information exchanges supporting the process of notification, coordination and transfer of flights and the process of civil-military coordination, integrated in systems operated in a simulated operational environment meets the interoperability and performance, quality of service and safety requirements of this Regulation.
Le fournisseur de services de navigation aérienne veille à ce que la mise en œuvre des échanges d’informations à l’appui des procédures de notification, de coordination et de transfert de vols et de la procédure de coordination civile-militaire, intégrés dans des systèmes fonctionnant dans un environnement opérationnel simulé, soit conforme aux exigences d’interopérabilité et de performance, de qualité de service et de sécurité définies par le présent règlement.
