12. For the purposes of subparagraphs 11(1)(a)(ii) and 11.1(a)(ii), where the costs that are directly attributable to the design or engineering of the goods (in this section referred to as “first-mentioned goods”) cannot be determined, but the costs that are directly attributable to the design or engineering of goods of the same general category as the first-mentioned goods, produced and sold by any exporter or producer, can be determined, the costs that are directly attributable to the design or engineering of the first-mentioned goods shall be considered to be the amount that reflects the cost of the design or engineering of the goods of the same general category, such amount being adjusted to reflect the value of any differences in the design or engineering between the first-mentioned goods and the goods of the same general category.
12. Gerry Byrne: With regard to the administration of all government departments, crown corporations and agencies as well as other entities within federal jurisdiction that offer goods or services to parliamentarians, to parliamentarians' staff, to the spouses or dependents of parliamentarians, or more generally to the offices of parliamentarians, hereafter referred to as “eligible parliamentary persons”, at either no cost or at a reduced cost compared to the rate normally charged to a member of the general public who might seek the provision of the same or a similar good or service from the government: without consideration or inclusion of any occasional discounts or promotions for fiscal years 2009-2010, 2010-2011, 2011-2012, and 2012-2013, and not including those goods or services provided directly to any eligible parliamentary persons under the normal rules of the administration of the House of Commons, the Senate or by the Library of Parliament, (a) which federal entities provided goods or services to those eligible parliamentary persons at either no cost or at a reduced cost; (b) what is each respective good or service thus provided, and what is the rationale for offering such no-cost goods or services or discounts to eligible parliamentary persons; (c) broken down by each such individual product or service, what is the cost to each federal entity, as measured in revenue that would otherwise not have been lost, of providing such goods or services to eligible parliamentary persons, calculated for each fiscal year and using the undiscounted rate that would be normally charged to members of the general public as the comparative basis for such a calculation; (d) what was the net financial position of each federal crown corporation or operating agency providing such goods or services before the provision of federal subsidies are considered in each fiscal year?

By deducing the similarity between the signs and the likelihood of confusion between the marks at issue from the similarity of elements of the signs — which correspond to a plainly descriptive indication for the condition of the goods (namely ‘navy blue’ as the colour indication for the goods utilised by the marks at issue) and, due to lack of inherent distinctive character, are not considered by the relevant public to be an indication of the commercial origin of the goods from a particular undertaking as distinguished from goods of other undertakings — the General Court misinterpreted that rule and the settled case-law on the determination of the similarity between the signs and the likelihood of confusion.

The acquis in this area covers protection of the economic interests of consumers in a number of specific sectors (misleading and comparative advertising, price indication, consumer credit, unfair contract terms, distance and doorstep selling, package travel, timeshare, injunctions for the protection of consumers' interests, certain aspects of the sale of consumer goods and associated guarantees), as well as general safety of consumer goods (liability for defective products, dangerous imitations and general safety of goods) and distance marketing of consumer financial services.

Without prejudice to the general rules on market access or the rules generally applicable to the transport of goods, the transport of dangerous goods shall be authorised, subject to compliance with the conditions laid down in Annex I, Section I. 1, Annex II, Section II. 1, and Annex III, Section III. 1.
