TRADUCTIONS EN CONTEXTE

Canadian nationals and refugees within the meaning of subparagraph (b) of Article 3 who reside in the territory of Canada shall also be entitled to voluntary coverage under German Pension Insurance if, under the provisions of the Convention on Social Security between the Federal Republic of Germany and Canada of March 30, 1971, they paid a voluntary contribution to German Pension Insurance at the latest on the day preceding the entry into force of the Agreement.
Les ressortissants canadiens et les réfugiés au sens de l’alinéa b) de l’article 3 qui résident sur le territoire du Canada sont également admissibles à l’assurance volontaire aux termes de l’assurance-pension allemande si, en vertu des dispositions de la Convention de sécurité sociale entre la République fédérale d’Allemagne et le Canada en date du 30 mars 1971, ils ont effectué une cotisation volontaire à l’assurance-pension allemande au plus tard le jour précédant l’entrée en vigueur du présent Accord.

(3) This Convention shall not apply to the legislation on social security adopted by the Council, or the Council and the Parliament, of the European Community, or to legally binding provisions on social security contained in agreements between the European Community, its Member States and a third country, or adopted pursuant to such an agreement, or to any convention on social security which the United Kingdom has concluded with a third party or to any laws or regulations which amend the legislation specified in paragraph (1) for the purpose of giving effect to such a convention.
(3) La présente Convention ne s’applique pas à la législation en matière de sécurité sociale adoptée par le Conseil, ou par le Conseil et le Parlement, de la Communauté européenne, ou aux dispositions régissant la sécurité sociale qui ont force obligatoire et qui sont contenues dans des accords entre la Communauté européenne, ses États membres et un pays tiers, ou adoptées en vertu d’un tel accord ou de toute convention en matière de sécurité sociale que le Royaume-Uni a conclu avec une tierce Partie ou des lois ou règlements qui modifient la législation visée au paragraphe (1) dans le but de rendre une telle convention applicable.

(6) These arrangements shall not apply to legislation on social security of the Institutions of the European Community or to any convention on social security which either Party has concluded with a third party or to any laws or regulations which amend the legislation specified in paragraph (3) for the purpose of giving effect to such a convention, but shall not prevent either Party taking into account under its legislation the provisions of any other convention which that Party has concluded with a third party.
(6) Les présents arrangements ne s’appliquent ni à la législation sur la sécurité sociale des institutions de la Communauté européenne, ni à toute convention sur la sécurité sociale que l’une ou l’autre des Parties a conclue avec un tiers, ni aux lois ou règlements qui modifient la législation visée au paragraphe (3) aux fins de donner effet à une telle convention. In the event of a negative answer to the first question (to the effect that application of the bilateral convention on social security is not excluded), is it possible to regard as more favourable, within the meaning of Article 8(1) of Regulation (EC) No 883/2004, legal rules on the basis of which a State signatory to the convention on social security recognises a shorter contributory period than that actually completed, and that State pays a pension of a greater amount than that to which entitlement would arise if the entire contributory period in the joint-signatory State were to be recognised?
