This solution, among other things, reflects the point n. 34. of the Report of the European Parliament of 25 November 2011 on modernisation of customs (2011/2083(INI)), that “Calls on the Commission to include in the MCC more rigorous requirements for the provision of the EU’s customs representation services, helping to increase the level of professionalism and ownership on the part of these intermediaries and laying down clear rules to guide relations between customs agents and forwarding undertakings, so as to change the role of the agents to that of consolidators for small and medium-sized importers that do not have the capacity to implement customs compliance programmes similar to those of European AEOs”.

in the case of exports referred to in Article 3 or 5, any natural or legal person that holds a contract with a consignee in a country to which the goods will be exported and that has the power for determining the sending of goods controlled by this Regulation out of the customs territory of the Community at the time when the customs declaration is accepted. If no export contract has been concluded or if the holder of the contract does not act on its own behalf, the power for determining the sending of the item out of the customs territory of the Community shall be decisive.

Unlike what happened in the case of the report on Bulgaria, in this case the Committee on Budgets wishes to stress the need to make sustained efforts to enhance Romania’s administrative capacity with regard to the essential fields of customs, VAT and statistics on gross domestic product. This means having appropriate capacity to collect and control VAT and customs duties, and to calculate gross domestic product credibly, precisely and exhaustively, in accordance with the SEC 95 rules.
Contrairement à ce qui s’est produit dans le cas du rapport sur la Bulgarie, la commission des budgets voudrait ici souligner que des efforts constants sont nécessaires pour renforcer la capacité administrative en Roumanie, s’agissant de questions politiques essentielles, telles que les douanes, la TVA et les statistiques relatives au PIB, ce qui implique que cette capacité doit être suffisante et permettre de dûment collecter et contrôler la TVA et les droits de douane et de calculer le PIB de manière précise, fiable et exhaustive, conformément aux normes du SCN 95.

Article 30 of the Treaty on European Union provides for common action of the Member States in the field of police cooperation. This action includes operational cooperation between the competent authorities, including the police, customs and other specialised law enforcement services of the Member States in relation to the prevention, detection and investigation of criminal offences (Article 30(1)a), and the collection, storage, processing, analysis and exchange of relevant information, including information held by law enforcement services on reports on suspicious financial transactions, in particular through Europol, subject to appropriate provisions on the protection of personal data (Article 30 (1)b).
