Langnese-Iglo claims that the Court of First Instance infringed the principle of proportionality in that it held that the Commission had not committed any error in withdrawing the benefit of the block exemption provided for by Regulation No 1984/83 of 22 June 1983 on the application of Article 85(3) of the Treaty to categories of exclusive purchasing agreements and prohibiting all exclusive purchase contracts concluded by Langnese-Iglo, without first having informed Langnese-Iglo of the extent to which a network of exclusive purchasing contracts was compatible with Article 85(1) of the Treaty and, therefore, without giving it an opportunity to adjust the network to the requirements of that provision.

By application lodged at the Registry of the Court of Justice on 18 August 1995, Langnese-Iglo GmbH brought an appeal, pursuant to Article 49 of the EC Statute of the Court of Justice, against the judgment of the Court of First Instance of 8 June 1995 in Case T-7/93 Langnese-Iglo v Commission [1995] ECR II-1533 in which that Court dismissed in part its application for the annulment of Commission Decision 93/406/EEC of 23 December 1992 relating to a proceeding pursuant to Article 85 of the EEC Treaty against Langnese-Iglo GmbH (IV/34.072) (hereinafter 'the contested decision').
Par requête déposée au greffe de la Cour le 18 août 1995, Langnese-Iglo GmbH a formé un pourvoi contre l'arrêt du Tribunal de première instance du 8 juin 1995, Langnese- Iglo/Commission ( ci-après l'«arrêt entrepris»), par lequel celui-ci a partiellement rejeté son recours tendant à l'annulation de la décision 93/406/CEE de la Commission, du 23 décembre 1992, relative à une procédure d'application de l'article 85 du traité contre Langnese-Iglo GmbH (Affaire IV/34.072) (ci-après la «décision litigieuse»).

In its appeal Langnese-Iglo maintains that the Commission had no authority to depart from the content of the comfort letter of 20 September 1985 and to prohibit the network of exclusive agreements maintained by Langnese-Iglo, unless an examination had shown that the legal and factual situation prevailing on the ice-cream market had changed appreciably.
Dans son pourvoi, Langnese-Iglo soutient que la Commission n'était pas autorisée à s'écarter du contenu de la lettre administrative de classement du 20 septembre 1985 (ci-après «lettre administrative») et à interdire le réseau de contrats d'achat exclusif entretenu par Langnese-Iglo, mis à part l'hypothèse où il serait résulté de l'examen que les éléments de droit et de fait sur le marché de la glace de consommation s'étaient sensiblement modifiés.

By its second ground of appeal Langnese-Iglo contests the conclusion reached by the Court of First Instance in paragraphs 94 to 114 that the Commission was right to consider that Langnese-Iglo's exclusive purchasing agreements involved an appreciable restriction of competition on the relevant market and were thus incompatible with Article 85(1) of the Treaty.
Par son deuxième moyen, Langnese-Iglo conteste la conclusion du Tribunal, aux points 94 à 114, selon laquelle la Commission aurait, à juste titre, considéré que les contrats d'achat exclusif entretenus par Langnese-Iglo entraînaient une restriction sensible du jeu de la concurrence sur le marché de référence, en sorte qu'ils étaient incompatibles avec l'article 85, paragraphe 1, du traité.

Under Article 85 of the EEC Treaty, the Commission has imposed interim measures in order to prevent Langnese-Iglo GmbH and Schoeller Lebensmittel GmbH Co. KG from enforcing contractual rights obliging retailers to purchase ice cream exclusively from them.
